83. Removal of doubt regarding non-applicability of the1[Karnataka] Rent Control Act, 1961 For the removal of doubt, it is hereby declared that the1[Karnataka] Rent Control Act, 1961,-- (a) shall not apply to any house belonging to or vesting in the Board under or for the purposes of this Act; (b) shall not apply as against the Board to any tenancies or other like relationship created by the Board in respect of such house, but (c) shall apply to any house let to the Board. _______________________________ 1. Title: Rights of Certain Persons Entitled to Sandal Trees

1[83. Rights of certain persons entitled to sandal trees (1) All persons who by the terms of their sannads, grants, or by judicial decision or otherwise are, prior to the commencement of this Act, legally entitled to the sandal trees in their lands shall not fell or sell such sandal tree or convert or dress sandal wood obtained from such tree or possess, store, transport or sell the sandal wood so obtained except in accordance with the provisions of the rules made under this Act. (2) On or after the commencement of the Karnataka Forest (Amendment) Act, 2001 every occupant or holder of land shall be legally entitled to the sandal tree in his land except where such sandal tree is declared to be the property of the State Government in any grant, lease, contract or other instrument, but such occupant or holder shall not fell or sell such sandal tree or convert or dress sandal wood obtained from such tree or posses, store, transport or sell the sandal wood so obtained except in accordance with the provisions of the rules made under this Act.] ______________________ 1. Title: Priority of Mortgage over Certain Claims

1[(1)] A mortgage executed in favour of a2[Agriculture and Rural Development Bank] shall have priority over any claim of the Government arising from a loan under3[the Karnataka Land Improvement Loans Act, 1963 (Karnataka Act 16 of 1963) or the Karnataka Agriculturists Loan, Act, 1963 (Karnataka Act 17 of 1963)] granted after the execution of the mortgage. 4[(2) Notwithstanding anything contained in the Karnataka Land Reforms Act, 1961, where a mortgage in favour of a2[Agriculture and Rural Development Bank] is in respect of land in which a tenant purchaser or tenant has an interest, the mortgage may be against the security of such interest and the rights of the mortgagee shall not be affected by the failure of the tenant purchaser or tenant to comply with the requirements of the said Act and the sale of the land and his interest therein under the said Act shall be subject to the prior charge of the2[Agriculture and Rural Development Bank].] ______________________ 1. Title: Continuance of Statutes, Regulations, Ordinances, Etc.

(1) Until the Statutes, Ordinances Regulations and Rules are made under the appropriate provisions of this Act, the Statutes, Ordinances, Regulations and Rules which were made under provisions of the Karnataka State Universities Act, 1976 and in force immediately before the commencement of this Act, shall subject to such adaptations or modifications as may be made therein by the Vice-Chancellor with the approval of Chancellor obtained through the State Government and in so far as they are not inconsistent with the provisions of this Act be deemed to be Statutes, Ordinances, Regulations and Rules made under the appropriate provisions of this Act. (2) The person holding the office of the Vice-Chancellor of the University established under the Karnataka State Universities Act, 1976, on the date of the commencement of this Act shall continue to hold office till such date he would have held that office, if this Act had not been passed.

Title: Punishment for Abetment of Escape of Persons Arrested

Any officer exercising powers under this Act, who,- (a) unlawfully releases any person arrested under this Act, or (b) abets the escape of any person arrested under this Act; or (c) abets the commission of any offence against this Act, and any other officer of the State Government or of a local authority who abets the commission of any offence against this Act, -shall, on conviction, be punished with imprisonment for a term which may extend to one year or with fine which may extend to one thousand rupees, or with both.

Title: Inquiry Regarding Illegal Transactions

Section 83 - Inquiry regarding illegal transactions The prescribed authority shall, after a summary inquiry, determine whether the transaction reported to it under section 82 or coming to its notice in any other manner is in contravention of1[or is unlawful or invalid under] the provisions of this Act,2[as they stood before or as they stand after the date of commencement of the Amendment Act] and make a declaration accordingly. Any transaction so declared to be in contravention of1[or is unlawful or invalid under] any of the provisions of this Act,2[as they stood before or as they stand after the date of commencement of the Amendment Act] shall be null and void.2[The land in respect of which such transaction has taken place shall, as penalty, be forfeited to and vest in the State Government3[free from all encumbrances]. Title: Remedy for Non-compliance with Directions Issued

If the owner or the person having control as aforesaid fails or neglects to comply with any such requisition within the time required by or under the provisions of section 83, Grama Panchayat may, and if in the opinion of the Secretary immediate action is necessary to protect the health or safety of any person, he shall at once, proceed to execute the work required by such notice, and all the expenses incurred thereon shall be paid by the owner, or person having control over such source of water supply, and shall be recovered in the same manner as an amount claimed on account of any tax recoverable under section 200: Provided that in the case of any well or private stream or any private channel, tank or other source of water supply the water of which is used by the public or by any section of the public as of right the expenses incurred by such owner or person having control may, if the Grama Panchayat so directs, be paid from the Grama Panchayat fund.

Title: Prohibition of Certain Acts

No person shall, (a) wilfully obstruct any person acting under the authority of the Board in setting out the lines of any works or pull up or remove any pillar, post or stake fixed in the ground for the purpose of setting out lines of such work, or deface or destroy any works made for the same purpose; or (b) wilfully or negligently break, injure, turn on, open, close, shut off or otherwise interfere with any lock, cock, valve, pipe, or other work or apparatus belonging to the Board; or (c) unlawfully obstruct the flow of or flush, draw off, divert or take sewage from any sewage work belonging to the Board; or (d) obstruct any officer or other employee of the Board in the discharge of his duties under this Chapter or refuse or wilfully neglect to furnish him with the means necessary for the making of any entry, inspection, examination or inquiry thereunder in relation to any sewage work.

Title: Provision of Meals and Refreshments

The State Government shall endeavour to provide mid-day meals and other refreshments as may be deemed necessary for pupils in attendance at recognised educational institutions. The State Government may make provisions by rules as to the manner in which and the persons by whom the expense of providing such meals or refreshments is to be defrayed, as to the facilities to be afforded and the services to be rendered by the Governing Council with respect to the provision of such meals or refreshments and as to such other consequential matters.
