Title : Sales Under Sections 83 to 85 Not to Affect the Right to Suit

Notwithstanding anything contained in this Chapter, the right of sale under sections 83 to 85 shall be without prejudice to the right of the railway administration to recover by suit, any freight, charge, amount or other expenses due to it.

Standards of Weights and Measures Enforcement Act, 1985 (54 of 1985) Chapter 9

Title : Provisions with Regard to the Sale and Distribution of Commodities in Packaged Form Within the State

(1) The provisions of the Standards Act and the rules made thereunder, as in force immediately before the commencement of this Act, with regard to commodities in packaged form shall, as far as may be, apply to every commodity in packaged form which is distributed, sold, or kept, offered or exposed for sale, in the State as if the provisions aforesaid were enacted by, or made under, this Act subject to the modification that any reference therein to the "Central Government", "Standards Act" and the "Director" shall be construed as references respectively, to the "State Government", "this Act" and the "Controller". (2) The State Government may make rules, not inconsistent with the Standards Act or any rule made thereunder, to regulate the packaging of any commodity intended to be sold or distributed, within the State in packaged form, or to regulate the sale or distribution, within the State, of any commodity in packaged form. Explanation.For the purposes of this section, "commodity in packaged form" shall have the meaning assigned to it in the Standards Act and shall include a pre-packed commodity.

Karnataka Panchayat Raj Act, 1993 Section 83

Title : Remedy for Non-compliance with Directions Issued

If the owner or the person having control as aforesaid fails or neglects to comply with any such requisition within the time required by or under the provisions of section 83, Grama Panchayat may, and if in the opinion of the Secretary immediate action is necessary to protect the health or safety of any person, he shall at once, proceed to execute the work required by such notice, and all the expenses incurred thereon shall be paid by the owner, or person having control over such source of water supply, and shall be recovered in the same manner as an amount claimed on account of any tax recoverable under section 200: Provided that in the case of any well or private stream or any private channel, tank or other source of water supply the water of which is used by the public or by any section of the public as of right the expenses incurred by such owner or person having control may, if the Grama Panchayat so directs, be paid from the Grama Panchayat fund.

Title : Inquiry Regarding Illegal Transactions

Section 83 - Inquiry regarding illegal transactions The prescribed authority shall, after a summary inquiry, determine whether the transaction reported to it under section 82 or coming to its notice in any other manner is in contravention of1[or is unlawful or invalid under] the provisions of this Act,2[as they stood before or as they stand after the date of commencement of the Amendment Act] and make a declaration accordingly. Any transaction so declared to be in contravention of1[or is unlawful or invalid under] any of the provisions of this Act,2[as they stood before or as they stand after the date of commencement of the Amendment Act] shall be null and void.2[The land in respect of which such transaction has taken place shall, as penalty, be forfeited to and vest in the State Government3[free from all encumbrances]. Title : Rights of Owner to Terminate Hire-purchase Agreement for Default in Payment of Hire or Unauthorised Act or Breach of Express Conditions

.....in any other case, the owner shall be entitled to terminate the agreement by giving the hirer notice of termination in writing: Provided that if the hirer pays or tenders to the owner the hire in arrears together with such interest thereon as may be payable under the terms of the agreement before the expiry of the said period of one week or. as the case may be, two weeks, the owner shall not be entitled to terminate the agreement. (2) Where a hirer-- (a) does any act with regard to the goods to which the agreement relates which is inconsistent with any of the terms of the agreement; or (b) breaks an express condition which provides that, on the breach thereof, the owner may terminate the agreement, the owner shall subject to the provisions of section 22, be entitled to terminate the agreement by giving the hirer notice of termination in writing.

Title : Termination of Bailment by Bailees Act Inconsistent with Conditions

A contract of bailment is a voidable at the option of the bailor, if the bailee does any act with regard to the goods bailed, inconsistent with the conditions of the bailment.
