(2) If the validity of the election is brought in question only on the ground of an error made by the officer charged with carrying out the rules relating to the elections or of an irregularity or informality not corruptly caused, the Munsiff shall not set aside the election. Explanation.--The expression "error" in this sub-section does not include any breach of or any omission to carry out or any non-compliance with the provisions of this Act or the rules made thereunder whereby the result of the election has been materially affected.

Title : Substitution of New Sections for Section 77

For section 77 of the principal Act, the following sections shall be substituted, namely:-- "77. Compensation, penalties or confiscation not to interfere with other punishment.-- No compensation awarded, penalty imposed or confiscation made under this Act shall prevent the award of compensation or imposition of any other penalty or punishment under any other law for the time being in force. 77A. Compounding of offences.-- A court of competent jurisdiction may compound offences, other than offences for which the punishment for life or imprisonment for a term exceeding three years has been provided, under this Act: Provided that the court shall not compound such offence where the accused is, by reason of his previous conviction, liable to either enhanced punishment or to a punishment of a different kind: Provided further that the court shall not compound any offence where such offence affects the socio economic conditions of the country or has been committed against a child below the age of 18 years or a woman. (2) The person accused of an offence under this Act may file an application for compounding in the court in which offence is pending for trial and the provisions.....

In section 77 of the principal Act,- (1) in the heading after the word "seals", a comma and the words ",electronic tax registers" shallbe inserted; (2) after sub-section (1) , the following sub-section shall be inserted, namely : "(1-A) Any registered dealer falling under sub-section (2-A) of section 31, who, (a) refuses to install an electronic tax register; or (b) refuses or fails to use the electronic register installed; or (c) removes or in any way tampers with the seal used to secure any electronic tax registerinstalled or destroys or attempts to destroy any electronic tax register installed, shall be liable on conviction by a Court, not inferior to that of a Magistrate of the First Class, to a fine of not less than five thousand rupees but not exceeding twenty five thousand rupees and imprisonment for a period not exceeding one year." In section 77 of the principal Act, in sub-section (1), for Explanations 1 and 3, the following Explanations shall be substituted, namely:-- 'Explanation 1.--For the removal of doubts, it is hereby declared that-- (a) the expenditure incurred by leaders of a political party on account of travel by air or by any other means of transport for propagating programme of the political party shall not be deemed to be the expenditure in connection with the election incurred or authorised by a candidate of that political party or his election agent for the purposes of this sub-section; (b) any expenditure incurred in respect of any arrangements made, facilities provided or any other act or thing done by any person in the service of the Government and belonging to any of the classes mentioned in clause (7) of section 123 in the discharge or purported discharge of his official duty as mentioned in the proviso to that clause shall not be deemed to be expenditure in connection with the election incurred or authorised by a candidate or by his election agent for the purposes of this sub-section.
