Title: The Governor General in Council to Have Control over the Presidencies

Title: Secretary of State in Council May Sue and Be Sued

The Secretary of State in Council shall and may sue and be sued as well in India as in England by the Name of the Secretary of State in Council as a Body corporate; and all Persons and Bodies Politic shall and may have and take the same suits, Remedies, and Proceedings, legal and equitable, against the Secretary of State in Council of India as they could have clone against the said Company; and the Property and effects hereby vested in Her Majesty for the purposes, of the Government of India acquired for the said purposes shall be subject and liable to the same judgments and Executions as they would while vested in the said Company have been liable to in respect of Debts and inabilities lawfully contracted and incurred by the said Company.

Indian Penal Code (45 of 1860) Section 65

Title: Limit to Imprisonment for Non-payment of Fine, when Imprisonment and Fine Awardable

The term for which the court directs the offender to be imprisoned in default of payment of a fine shall not exceed one-fourth of the term of imprisonment which is the maximum fixed for the offence, if the offence be punishable with imprisonment as well as fine.

Indian Contract Act, 1872 Section 65

Title: Obligation of Person Who Has Received Advantage Under Void Agreement, or Contract That Becomes Void

.....of rice before the first of May. A delivers 130 maunds only before that day, and none after. B retains the 130 maunds after the first of May. He is bound to pay A for them. (c) A, a singer, contracts with B, the manager of a theatre, to sing at his theatre for two nights in every week during the next two months, and B engages to pay her a hundred rupees for each night's performance. On the sixth night, A wilfully absents herself from the theatre, and B, in consequence, rescinds the contract. B must pay A for the five nights on which she had sung. (d) A contracts to sing for B at a concert for 1,000 rupees, which are paid in advance. A is too ill to sing. A is not bound to make compensation to B for the loss of the profits which B would have made if A had been able to sing, but must refund to B the 1,000 rupees paid in advance

Title: Part Vi Not to Apply to Roman Catholics. Saving of Certain Marriages

This Part of this Act, except so much of sections 62 and 63 as are referred to in section 64, shall not apply to marriages between Roman Catholics. But nothing herein contained shall invalidate any marriage celebrated between Roman Catholics under the provisions of Part V of Act No.25 of 1864 {Act 25 of 1864 had been rep. by Act 5 of 1865, which was rep. by this Act.}, previous to the twenty-third day of February, 1865.

Indian Evidence Act 1872 Section 65

Title: Cases in Which Secondary Evidence Relating to Documents May Be Given

State: Central

.....within the meaning of section 74; (f) when the original is a document of which a certified copy is permitted by this Act, or by any other law in force in1[India] to be given in evidence2; (g) when the original consists of numerous accounts or other documents which cannot conveniently be examined in Court and the fact to be proved is the general result of the whole collection. In cases (a), (c) and (d), any secondary evidence of the contents of the document is admissible. In case (b), the written admission is admissible. In case (e) or (f), a certified copy of the document, but no other kind of secondary evidence, is admissible. In case (g), evidence may be given as to the general result of the documents by any person who has examined them, and who is skilled in the examination of such documents. ________________________ 1. Northern India Canal and Drainage Act, I873 Section 65

Title: Procedure for Obtaining Labour for Works Urgently Required

.....from time to time alter the rates to be paid to any such labourers: Provided that such rates shall exceed the highest rates for the time being paid in the neighbourhood for similar work. In the case of every such labourer, the payment shall continue the whole period during which he is, in consequence of the provisions of this part, prevented from following his ordinary occupation. The State Government may {The words "with the previous sanction of the G.G.in C." were by Act 4 of 1914.} direct that t provisions of this part shall apply, either permanently or temporarily (as the case may be), to any district or part of a district for t purpose of effecting necessary annual silt-clearances, or to prevent proper operation of a canal or drainage-work being stopped or much interfered with as to stop the established course of irrigation or drainage.

Title: Collector to Prepare and Keep Register

The Collector shall prepare and keep all Registers necessary for the purposes of this Act in the form which 1[the 2[State] Government] may from time to time prescribe.
