Title: Functions of the Chiefcommissioner

State: Central

Year: 1995

The Chief Commissioner shall-- (a) coordinate the work of the Commissioners; (b) monitor the utilisation of funds disbursed by the Central Government; (c) take steps to safeguard the rights and facilities made available to persons with disabilities; (d) submit reports to the Central Government on the implementation of the Act at such intervals as the Government may prescribe.

Wakf Act, 1995 Section 58

Title: Power of Board to Pay Dues in Case of Default by Mutawalli

State: Central

Year: 1995

(1) Where a mutawalli refuses to pay or fails to pay any revenue, cess, rates or taxes due to the Government or any local authority, the Board may discharge dues from the Wakf Fund and may recover the amount so paid from the wakf property and may also recover damages not exceeding twelve and a half per cent. of the amount so paid. (2) Any sum of money due under sub-section (1) may, on a certificate issued by the Board after giving the mutawalli concerned an opportunity of being heard, be recovered in the same manner as an arrear of land revenue.

Delhi Rent Act, 1995 Section 58

Title: Power to Punish for Contempt

State: Central

Year: 1995

The Tribunal shall have, and exercise, the same jurisdiction, powers and authority in respect of contempt of itself or of the Rent Authority under this Act as a High Court has and may exercise and, for this purpose, the provisions of the Contempt of Courts Act, 1971(70 of 1971), shall have effect subject to the modification that-- (a) the references therein to a High Court shall be construed as including a reference to the Tribunal; (b) in section 15 of the said Act, the references to the Advocate-General shall be construed as a reference to the Attorney-General or the Solicitor-General or the Additional Solicitor-General; (c) in sections 6, 10, 11A, 12, 15 and 17 of the said Act, the references therein to subordinate Court or Court subordinate, shall be construed as including a reference to Rent Authority under this Act; and (d) the references, in section 14 of the said Act, to Chief Justice, Judge or Judges shall be construed as including a reference to Chair man, Member or Members.

Finance Act, 1995 Section 58

Title: Amendment of Section 45

State: Central

In section 45 of the Customs Act, after sub-section (2), the following sub-section shall be inserted,"(3) Notwithstanding anything contained in any law for the time being in force, if any imported goods are pilfered after unloading thereof in a customs area while in the custody of a person referred to in sub-section (1), that person shall be liable to pay duty on such goods at the rate prevailing on the date of delivery of an import manifest or, as the case may be, an import report to the proper officer under section 30 for the arrival of the conveyance in which the said goods were carried.

Wakf Act, 1995 Section 18

Title: Committees of the Board

(1) The Board may, whenever it considers necessary, establish either generally or for a particular purpose or for any specified area or areas committees for the supervision of wakfs. (2) The constitution, functions and duties and the term of office of such committees shall be determined from time to time by the Board: Provided that it shall not be necessary for the members of such committees to be members of the Board.

Textile Undertakings (Nationalisation) Act,1995 Section 34

Title: Textile Companies Not to Be Wound Up by the Court

No proceeding for the winding up of a textile company, the right, title and interest in relation to the textile undertaking owned by which have vested in the National Textile Corporation under this Act or for the appointment of a receiver in respect of the business of the textile undertaking shall lie or be proceeded with in any Court except with consent of the Central Government.

Textile Undertakings (Nationalisation) Act,1995 Section 38

Title: Repeal and Saving

(1) The Textile Undertakings (Nationalisation) Ordinance, 1995, is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the said Ordinance shall be deemed to have been done or taken under the corresponding provisions of this Act.

Wakf Act, 1995 Section 1

Title: Short Title, Extent and Commencement

State: Central

Year: 1995

(1) This Act may be called the Wakf Act, 1995. (2) It extends to the whole of India except the State of Jammu and Kashmir. (3) It shall come into force in a State on such date1as the Central Government may, by notification in the Official Gazette, appoint; and different dates may be appointed for different areas within a State and for different provisions of this Act, and any reference in any provision to the commencement of this Act, shall, in relation to any State or area therein be construed as reference to the commencement of that provision in such State or area. ______________________ 1 . 1st January, 1996, 1996 vide S.O. 1007(E) dated 27th December, 1995.

Wakf Act, 1995 Section 2

Title: Application of the Act

Save as otherwise expressly provided under this Act, this Act shall apply to all wakfs whether created before or after the commencement of this Act: Provided that nothing in this Act shall apply to Durgah Khawaja Saheb, Ajmer to which the Durgah Khawaja Saheb Act, 1955 (36 of 1955) applies.

Wakf Act, 1995 Section 9

Title: Establishment and Constitution of Central Wakf Council

State: Central

Year: 1995

.....Minister in charge of wakfs-ex-officio Chairperson; (b) the following members to be appointed by the Central Government from amongst Muslims, namely: (i) three persons to represent Muslim organisation shaving all-India character and national importance; (ii) four persons of national eminence, of whom two shall be from amongst persons having administrative and financial expertise; (iii) three Members of Parliament of whom two shall be from the House of the People and one from the Council of States; (iv) chairpersons of three Boards by rotation; (v) two persons who have been Judges of the Supreme Court or a High Court; (vi) one advocate of national eminence; (vii) one person to represent the mutawallis of the wakf having a gross annual income of rupees five lakhs and above; (viii) three persons who are eminent scholars in Muslim Law. (3) The term of office of, the procedure to be followed in the discharge of their functions by, and the manner of filling casual vacancies among, members of the Council shall be such as may be prescribed by rules made by the Central Government.
