Karnataka Municipal Corporations Act, 1976 Section 58

Title: Obligatory Functions of the Corporations

State: Karnataka

.....corporation, receptacles, fittings, pipes and other appliances whatsoever on or for the use of premises for receiving and conducting the sewage thereof into drains under the control of the corporation; 1 [(28A) vital statistics including registration of births and deaths; (28B) regulation of tanneries.] (29) taking measures to meet any calamity affecting the public; (30) fulfillment of any obligation imposed by or under this Act or any other law for the time being in force and discharge of functions in respect of any matter entrusted to the corporation by Government by notification; (31) subject to adequate provision being made for the matters specified above, the provision of relief to destitute persons in the city in times of famine and scarcity and the establishment and maintenance of relief works in such times. _______________ 1. Improvement Boards Act, 1976 Section 58

Title: Supersession of the Board

State: Karnataka

(1) If the Government is satisfied that the Board has made default in performing any duties imposed on it by or under this Act or any other law or has abused its power or is acting in a manner prejudicial to the interests of the Board or its finances the Government may by notification, supersede and reconstitute the Board: Provided that before issuing the notification under this sub-section the Government shall give an opportunity to the Board to make a representation why it should not be superseded and shall consider the representation, if any, made. (2) After the supersession of the Board and until it is reconstituted, the powers, duties and functions of the Board shall be exercised by such officer or officers as the Government may appoint.

Title: Penalty for Contravention of Section 35

Whoever, being required by or under this Act so to do, without any reasonable excuse, omits or fails to maintain any record or register, or being required by the Director or the authorised officer, to produce any record or register for his inspection, omits or fails, without any reasonable excuse, so to do, shall be punished with fine which may extend to one thousand rupees, and, for the second or subsequent offence , with imprisonment for a term which may extend to six months and also with fine.

Title: Bar of Suit in Absence of Notice

(1) No suit or other legal proceeding shall be instituted against the Board or any Market Committee or any, member, officer or servant thereof or any person acting under the direction of any such Board, Market Committee, member, officer or servant for anything done or purported to be done, in good faith as such member, officer, or servant under this Act, until, the expiration of two months next after notice in writing, stating the cause of action, the name and place of residence of the intending plaintiff and the relief which he claims, has been, in the case of the Board or Market Committee, delivered or left at its office, and in the case of any such member, officer, servant or person as aforesaid, delivered to him or left at his office or usual place of residence, and the plaint shall contain a statement that such notice has been so delivered or left. (2) Every such suit shall be dismissed unless it is instituted within six months from the date of accrual of the alleged cause of action. (3) Nothing in this section shall be deemed to apply to any suit instituted under section 38 of the Specific Relief Act, 1963.

Title: Contracts to Cease to Have Effect Unless Ratified by the Central Government or Government

.....in writing, by the Central Government or the Government company, and, in ratifying such contract, the Central Government or the Government company may make such alteration or modification therein as it may think fit: Provided that the Central Government or the Government company shall not omit to ratify a contract, and shall not make any alteration or modification in a contract, unless it is satisfied that such contract is unduly onerous or has been entered into in bad faith or detrimental to the interests of the Central Government or the Government company. (2) The Central Government or the Government company shall not omit to ratify a contract, and, shall not make any alteration or modification therein, except after giving to the parties to the contract a reasonable opportunity of being heard and except after recording, in writing, its reasons for refusal to ratify the contract or for making any alteration or modification therein.

Title: Power to Remove Difficulties

If any difficulty arises in giving effect to the provisions of this Act, the Central Government may, by order, not inconsistent with the provisions of this Act, remove the difficulty; Provided that no such order shall be made after the expiry of a period of two years from the date on which this Act receives the assent of the President.
