Title: Amendment of Orders

Clerical or arithmetical mistakes in orders arising therein from any accidental slip or omission may at any time be corrected by the Revenue Officer passing the order or by any of his successors in office, either on his own motion or on the application of any of the parties concerned: Provided that no such correction shall be made without giving a reasonable opportunity to the parties to be heard.

Title: Motions and Amendments

(1) Every motion or any amendment thereof shall be received in writing and then duly moved. Every motion shall be seconded, and until seconded no debate thereon shall take place nor shall it be put to vote. No amendment which merely negatives an original motion shall be allowed. (2) Any motion or amendment may be withdrawn by its proposer with theconsent of the municipal council. (3) An amendment to an amendment may be moved at any stage of thedebate. (4) On the conclusion of the debate, in the event of there being severalamendments to an amendment, the presiding authority shall put the last amendment to vote first and after it is disposed of the next preceding amendment shall be put to vote and so on until all the amendments are disposed of. The original motion or the amended motion, as the case may be, shall then be put to vote. (5) When any motion or amendment involves many points the presidingauthority may divide it and put each point to vote separately. (6) When a motion or amendment has been put to vote and declared bythe presiding authority as carried, no further proposals for amending the motion or amendment shall be entertained.

Title: Power to Execute Work After Giving Notice to the Person Liable

(1) When under the provisions of this Chapter any person may be required or is liable to execute any work, the Board may, in accordance with the provisions of this Act and of any rule or regulation made in this behalf, cause such work to be executed after giving such person an opportunity of executing the same within such time as may be specified by it for this purpose. (2) The expenses incurred or likely to be incurred by the Board in the execution of any such work shall be payable by the said person and the expenses incurred by the Board in connection with the maintenance of such work shall be payable by the person or persons enjoying the amenities and conveniences rendered possible by such work. (3) The expenses referred to in sub-section (2) shall be recoverable from the person or persons liable therefor as an arrear of charges payable under this Act.

Title: Causing Damage to Highways

Whoever in contravention of sub-section (1) of section 54 wilfully causes, or allows any vehicle or animal in his charge to cause any damage to any highway, shall, on conviction, be punished with fine which may extend to one thousand rupees.

Title: Service of Notices and Bills

(1) Every notice or bill issued or prepared under this Act, may be served or presented,-- (a) by delivering or tendering it or sending it by registered post to the person to whom it is addressed, or to his agent, or (b) if such a person or his agent is not found, then by leaving it at his usual or last known place of abode or by delivering or tendering it to some adult male member of his family or by causing it to be fixed on some conspicuous part of the building or land, if any, to which it relates. (2) Where a notice under this Act is required to be served upon an owner or occupier of a building or land, it shall not be necessary to name the owner or occupier, and the service thereof may be effected either,-- (a) by delivering or tendering the notice or sending it by registered post to the owner or occupier or if there be more owners or occupiers than one, to any one of them, or (b) if no such owner or occupier is found, then by giving or tendering the notice to an adult male member or servant of his family or by causing the notice to be fixed on some conspicuous part of the building or land to which the same relates. Title: Protection of Persons Acting in Good Faith and Limitation of Suit or Prosecution

(1) No suit or prosecution or other legal proceeding shall be instituted against any public servant or officer or persons duly authorised under this Act in respect of anything in good faith done or intended to be done under this Act, or the rules or orders made thereunder. (2) No suit or prosecution shall be instituted against any public servant or officer or person duly authorised under this Act in respect of anything done or intended to be done under this Act, except with the previous sanction of the State Government.

Title: Summary Eviction
State: Karnataka

Any person wrongfully occupying any land,-- (a) which is part of a highway, (b) the occupation of which contravenes any of the provisions of this Act and the said provisions do not provide for the eviction of such person, shall be summarily evicted by the Deputy Commissioner in the prescribed manner on being required to do so by the Highway Authority or any officer authorised in this behalf by the State Government.
