Title: Special Provision for Application Under Section 24 in Respect of Land Situate in Merged Territories

Notwithstanding anything contained in section 24 of this Act as amended by Bombay Merged States (Laws) Act, 1950, in its application to the merged territories, an agricultural labourer entitled to apply under section 24 for a declaration that a transfer of any land situate in any of the merged territories is a mortgage, may make an application under the said section within six months from the date of the coming into operation of the Bombay Agricultural Debtors Relief (Amendment) Act, 1950, to the Court of the Civil Judge (Senior Division) having ordinary jurisdiction in the area in which such land is situate, and if there is no such Civil Judge to the Court of the Civil Judge (Junior Division) having jurisdiction in the said area.]

Title: Duty of Certain Village Officers to Report Appearance of Insect Pest, Plant Disease or Noxious Weed

(1) If any insect pest, plant disease or noxious weed appears in any village adjoining a notified area, the village officers of such village shall forthwith report the fact to the Collector or such other officer as the 1[State] Government may appoint in this behalf. (2) The Collector or such other officer, as the case may be, shall on receipt of such report and after making such further inquiry as he may deem necessary forward it to the 1[State] Government with his remarks thereon. _______________ 1. Title: Power to Declare Insect Pests, Plant Diseases and Noxious Weeds and Direct Measures to Eradicate or Prevent Them

Title: Paying Capacity

The paying capacity of the debtor, shall, for the purposes of this Act, be deemed to be sixty per cent of the value of all the property of the debtor : Provided that when any portion of such property yields income but the market value of such portion cannot be determined, the value of such portion shall be the amount of the income capitalized at six per cent. per annum.

Title: Examination of Creditor and Debtor

In an application for the adjustment of debts if the amount of the creditor's claim is disputed, the Court shall, when taking accounts, examine both the creditor and the debtor as witnesses, unless for reasons to be recorded the Court deems it unnecessary so to do.
