Section 58 - Arrest, search, etc., how to be made Any person arrested under this Act shall be informed, as soon as may be, of the grounds for such arrest and save as in this Act otherwise expressly provided, the provisions of the1[Code of Criminal Procedure, 1973], relating to arrest, detention in custody, searches, summonses, warrants of arrests, search-warrants, the production of persons arrested and the disposal of things seized, shall apply, as far as may be, to all action taken in these respects under this Act: 2[Provided that no search shall be deemed to be irregular by reason only of the fact that witnesses for the search are not inhabitants of the locality in which the place searched is situated.] _______________________________ 1. Any fine imposed by a Controller under this Act shall be paid by the person fined within such time as may be allowed by the Controller and the Controller may, for good and sufficient reason extend the time, and in default of such payment, the amount shall be recoverable as arrears of land revenue under the Karnataka Land Revnue Act, 1964.

Section 58 - Elections (1) The conduct of elections of the Board of Directors of the Federal Co-operative shall be the responsibility of the incumbent board of the Federal Co-operative. Elections shall be conducted before the expiry of the term of the office of the outgoing directors in the manner specified in the bye-laws.1[The Registrar shall appoint a returning officer for conducting such elections.] (2) The newly elected directors shall assume office immediately after expiry of the term of the outgoing board. (3) Where the number of nominations exceeds the number of directors to be elected, the election of directors shall be by secret ballot. ___________________ 1. Title: Vesting in the State Government of Land Leased Contrary to the Act

1[58. Vesting in the State Government of land leased contrary to the Act (1) Where it appears to the Tahsildar that any person has leased land contrary to the provisions of this Act, he shall issue a notice to such person to show cause within fifteen days from the date of service of the notice why the land leased should not be forfeited to the State Government as penalty for contravention of the Act. (2) If the Tahsildar on considering the reply or other cause shown is satisfied that there has been such a lease he may, by order, declare that the right, title and interest of such person in the land shall be forfeited to the State Government as penalty. Thereupon the land shall vest in the State Government and the Tahsildar may take possession thereof by summarily evicting any person occupying it.1[No amount shall be payable in respect of such land.] (3) Such land shall be disposed of in accordance with the provisions of section 77.] ______________________________________ 1. .....rule or order made or of any licence, pass, permit or authorisation granted thereunder,- (a) imports or exports any intoxicant or hemp; (b) manufactures any intoxicant; (c) constructs or works any distillery or brewery; (d) bottles liquor; (e) sells or buys any liquor or intoxicant or hemp; (f) uses, keeps or has in his possession any materials, still, utensil, implement or apparatus for the purpose of manufacturing any intoxicant other than today; (g) keeps or has in his possession any materials which have undergone any process towards the manufacture of liquor or any intoxicating drug or from which any liquor or intoxicating drug has been manufactured, -shall, on conviction, be punished,- (i) for a first offence, with imprisonment for a term which may extend to one year or with fine which may extend to one thousand rupees, or with both: Provided that in the absence of any special and adequate reasons to the contrary to be mentioned in the judgment of the Court, such imprisonment shall not be less than six months and fine shall not be less than five hundred rupees; (ii) for a second offence, with imprisonment for a term which may extend to two years and.....

Title: Duty of the Board to Undertake Labour Housing Schemes

(1) It shall be the duty of the Board to provide for the welfare of labour by providing proper houses for employees as near as possible to their place of work of such types and designs in accordance with such schemes as the State Government may approve. (2) The Board may, in addition to preparing and carrying out schemes for the provision of suitable housing accommodation for employees, promote measures directed towards,-- (i) the provision of gardens, playgrounds and recreational facilities; (ii) the improvement of public health and sanitation; (iii) provision of water supplies and facilities for washing; (iv) the provision of transport to and from work; and may incur in respect of such measures expenditure from the fund of the Board within such limits as may be prescribed by the State Government.

Title: Amendment of Orders

Clerical or arithmetical mistakes in orders arising therein from any accidental slip or omission may at any time be corrected by the Revenue Officer passing the order or by any of his successors in office, either on his own motion or on the application of any of the parties concerned: Provided that no such correction shall be made without giving a reasonable opportunity to the parties to be heard.

Title: Disputes as to Constitution of University Authorities

If any question arises regarding the interpretation of any provision of this Act, or of any Statute or Regulation, or as to whether a person has been duly appointed as, or is entitled to be, a member of any Authority of the University, the matter may be referred to the Chancellor, and shall be so , referred to him if six members of the Board so require. The Chancellor shall, after taking such advice, as he deems necessary, decide the question, and his decision shall be final.
