Scheduled Areas Assimilation of Laws Act, 1951 Section 3

Title: Assimilation of Laws

(1) All laws which immediately before the appointed day extend to, or are in force in, the scheduled areas shall on that day cease to be in force in the scheduled areas except as respects things done or omitted to be done before that day, and for the removal of doubts, it is hereby declared that section 6 of the General Clauses Act, 1897 (X of 1897) shall apply in relation to such cesser as it applies in relation to the repeal of an enactment by a Central Act. (2) All laws which immediately before the appointed day extend to, or are in force in, the Darrang district of the State of Assam shall as from that day extend to, or as the case may be come into force in, the areas specified in paragraph 1 of the Schedule. (3) All laws which immediately before the appointed day extend to, or are in force in, the Lakhimpur district of the State of Assam shall as from that day extend to, or, as the case may be, come into Force in, the areas specified in paragraphs 2 and 3 of the Schedule.

Scheduled Areas Assimilation of Laws Act, 1951 Section 4

Title: Transitional Provisions

Year: 1951

Notwithstanding anything contained in section 3, the Central Government of the State of the Assam may, by order, direct that during such period, not exceeding twelve months from the appointed day, as may be specified in the order, any law which immediately before the appointed day was in force in the scheduled areas, shall be deemed to have continued to be deemed to have continued to be in force therein or any specified part thereof, and may further likewise direct that any law which would have extended to, or come into force in, the scheduled areas on the appointed day, shall not be deemed to have extended thereto or come into force therein or any specified part thereof.

Notwithstanding anything contained in section 3, all suits, ceases and other legal proceedings between the parties all of whom belong to the Scheduled Tribes specified in Item 2 of Part I--Assam, of the Schedule to the Constitution (Scheduled Tribes) Order, 1950, or such other tribe or tribes, as may be specified in this behalf, shall be tried and continue to be tried under the Assam Frontier (Administration of Justice) Regulation, 1945 (Regulation 1 of 1945) as if this Act had not been passed.

Scheduled Areas Assimilation of Laws Act, 1951 Section 6

Title: Provision for Removal of Difficulties

Title: Saving of Pending Proceedings for Winding Up

Where the winding up of a company has commenced before the commencement of this Act,-- (i) sub-section ( 7) of section 555 shall apply in respect of any moneys paid into the Companies Liquidation Account whether before or after such commencement; and (ii) the other provisions with respect to winding up contained in this Act shall not apply, but the company shall be wound up in the same manner and with the same incidents as if this Act had not been passed: 1[Provided that where the proceedings in any such winding up are pending at the commencement of the Companies (Amendment) Act, 1960,-- (a) sections 463, 502, 515 and 524 shall, as far as may be, also apply in relation thereto; (b) the liquidator appointed by the court and functioning in any such winding up shall in such manner and at such time as may be prescribed by the Central Government, pay the moneys received by him as such liquidator, into the public account of India in the Reserve Bank of India.] _________________________ 1. Title: Unpaid Dividends and Undistributed Assets to Be Paid into the Companiesliquidation Account

(6) Where the company is being wound up voluntarily 3 [the Tribunal] the liquidator shall, when filing a statement in pursuance of sub-section (1) of section 551, indicate the sum of money which is payable to the Reserve Bank of India under sub-sections (1) and (2) of this section which he has had in his hands or under his control during the six months preceding the date to which the said statement is brought down, and shall, within fourteen days of the date of filing the said statement, pay that sum into the Companies Liquidation Account. (7) (a) Any person claiming to be entitled to any money paid into the Companies Liquidation Account (whether paid in pursuance of this section or under the provisions of any previous companies law) may apply to the 4 [Tribunal] for an order for payment thereof, and the 4 [Tribunal], if satisfied that the person claiming is entitled, may make an order for the payment to that person of the sum due: Provided that before making such an order, the 4 [Tribunal] shall cause a notice to be served on such officer as the Central Government may appoint in this behalf calling on the officer to show cause within one month from the date of.....
