(15) "legal practitioner" means any legal practitioner within the meaning of the Legal Practitioners Act, 1879 (Act XVIII of 1879), except a Mukhtar; (16) "net assets" of an estate or group of estates means the estimated average annual surplus produce of such estate or group of estates remaining after deduction of the ordinary expenses of cultivation as ascertained or estimated. Explanation" Ordinary expenses of cultivation include payments, if any, which the land-owner customarily bears, whether in kind or in cash, and in whole or in part whether in respect of" (a) water rates, (b) maintenance of means of irrigation, (c) maintenance of embankments, (d) supply of seed, (e) supply of manure, (f) improved implements of husbandry, (g) concessions with regard to fodder, (h) special abatements made for fallow or bad harvest, (i) cost of collection of rent, (j) allowance for shortage in collection of rent, (k) interest charges payable in respect of advances made in cash, free of interest, to tenants for the purpose of cultivation, (l) wages or customary dues paid to village auxiliaries whose products or labour are utilized for the.....

Title: Application of Act

(1) This Act shall apply to any cash grant specified in the Schedule other than those mentioned in sub-section (2). (2) Nothing contained in this Act shall apply to any such cash grant given in the name, or for the support, of any religious or charitable institution or given to any person for the performance of any service or charity, such service or charity being of a public nature connected with any religious or charitable institution: Provided that the payment of cash grant mentioned in this sub-section shall be made to the institution or to the person concerned only so long as the institution exists. (3) For the removal of doubts, it is hereby declared that the provisions of section 5 of the Hyderabad Atiyat Enquiries Act, 1952 (Hyderabad Act X of 1952), as in force in the Hyderabad Area, shall apply to the cash grants continued by this Act as they apply to Atiyat grants under that Act. (4) The Government may, by notification in the official Gazette, alter, add to or omit any of the entries in the Schedule.

Abolition of Cash Grants Act, 1967 (15 of 1967) Section 4

Title: Abolition of Certain Grants and Payment of Compensation Therefor

.....male minor before attainment of 18 years of age, or by a female minor before such attainment or marriage, falls short of four times the annual amount of cash grant, the deficiency shall be made good to the male minor on his attaining 18 years of age, and to the female minor on her attaining 18 years of age or her marriage, whichever is earlier. (4) Where a cash grant to which this Act applies is subject to the rendering of any service, the grantee shall, with effect from the date of discontinuation of the grant, stand relieved of the liability to render that service. (5) The compensation payable under sub-section (2) for the cash grants specified in Part A and Part C of the Schedule shall be paid to the grantee in such manner and in such installments as may be prescribed; and the compensation payable for the cash grant specified in Part B of the Schedule shall be paid to him either in full or in annual installments not exceeding twelve.

Title: Power to Make Rules

(1) The Government may, by notification in the official Gazette, make rules to carry out all or any of the purposes of this Act. (2) Every rule made under this section shall be laid as soon as may be after it is made, before each House of the State Legislature while it is in session for a total period of thirty days which may be comprised in one session or in two successive sessions and if before the expiry of the session in which it is so laid or the session immediately following, both Houses agree in making any modification in the rule or both houses agree that the rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect, as the case may be; so however that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule.

.....The provisions of this Act or any rule or order made thereunder shall have effect notwithstanding anything inconsistent therewith contained in any enactment other than this Act or any instrument having effect by virtue of any enactment other than this Act. Section 49 - Protection of Action Take in Good Faith No suit, prosecution or other legal proceeding shall lie against- (a) the Central Government or a State Government or any officer or authority of the Central Government or State Government or District Magistrate or any officer authorised in this behalf by the Government or the District Magistrate or any other authority on whom powers have been conferred under this Act, for anything which is in good faith done or purported to be done in pursuance of this Act or any rule or order made thereunder; and (b) any serving or retired member of the armed forces or paramilitary forces in respect of any action taken or purported to be taken by him in good faith, in the course of any operation directed towards combating terrorism. Section 50 - Saving Nothing in this Act shall affect the jurisdiction cxercisable by, or the procedure applicable to, any court or other authority.....

.....apply to any proprietor in regard to whose property a declaration has been made under section 17. (2) No claim under section 68 of the Indian Contract Act, 1872 (9 of 1872), shall be enforceable against the property of a ward which is under the superintendence of the court; but the court may, in its discretion, satisfy in whole or in part, any such claim. 34.
