Finance Act, 1992 Section 99

Title: Amendment of Section 45

In section 45 of the Wealth-tax Act, with effect from the 1st day of April, 1993, - (a) clauses (a) to (e) shall be omitted; (b) for clause (h), the following clause shall be substituted, namely :- "(h) any social club;".

Karnataka Prisons Act, 1963 Section 46

Title: Punishment of Offences Under Section 45

The Superintendent may examine any person touching any offence declared to be a prison offence under section 45, and determine thereupon and punish such offence by,- (1) a formal warning; Explanation.--A formal warning shall mean a warning personally addressed to a prisoner by the Superintendent and recorded in the punishment book and on the prisoner's history-ticket. (2) change of labour to some more irksome or severe form for such period as may be prescribed; (3) hard labour for a period not exceeding seven days in case of convicted criminal prisoners not sentenced to rigorous imprisonment; (4) such loss of privileges admissible under the remission or furlough system for the time being in force as may be prescribed; (5) separate confinement for any period not exceeding two months: Provided that while executing punishment of separate confinement, no prisoner shall be kept in separate confinement continuously for more than a fortnight at one time and the interval between one period of confinement and the next will be at least a week. Explanation.--"Separate confinement" means such confinement with or without labour as entirely secludes a prisoner from.....

Bombay Non-trading Corporations Act, 1959, (Maharashtra) Section 79

Title: Penalty Contravention of Section 45

State: Maharashtra

Year: 1959

Any director of a corporation who makes a declaration under section 45 without having reasonable grounds for the opinion that the corporation will be able to pay its debts, shall, on conviction, be punished with imprisonment for a term which may extend to six months, or with fine which may extend to five hundred rupees or with both. Explanation.-If the corporation is wound up in pursuance of a reasolution passed within a period of five weeks after the making of the declaration, but its debts are not paid or provided for in full within the period specified in the declaration, it shall be presumed, until the contrary is proved, that the director did not have reasonable grounds for his opinion.
