Title: Alteration in the Register and Cancellation of Certificate

(1) Where an order is made under this Act reprimanding a member, a record of the punishment shall be entered against his name in the Register. (2) Where the name of any member is removed, the certificate of practice granted to him under this Act shall be recalled and cancelled.

Title: Filling of Casual Vacancies

All the casual vacancies among the members (other than ex officio members) of any authority or other body of the University shall be filled, as soon as may be convenient, by the person or body who appoints, elects or co-opts the members whose place has become vacant and any person appointed, elected or co-opted to a casual vacancy shall be a member of such authority or body for the residue of the term for which the person whose place he fills would have been a member.

Title: Civil Court Not to Have Jurisdiction

No civil court shall have jurisdiction to entertain any suit or proceeding in respect of any matter which a Debts Recovery Tribunal or the Appellate Tribunal is empowered by or under this Act to determine and no injunction shall be granted by any court or other authority in respect of any action taken or to be taken in pursuance of any power conferred by or under this Act or under the Recovery of Debts Due to Banks and Financial Institutions Act, 1993 (51 of 1993).

Title: Offences in Respect of Property

Any person subject to this Act who commits any of the following offences, that is to say,-- (a) commits theft of any property belonging to the Government or to any Coast Guard mess, or institution, or to any person subject to this Act or (b) dishonestly misappropriates or converts to his own use any such property; or (c) commits criminal breach of trust in respect of any such property; or (d) dishonestly receives or retains any such property in respect of which any of the offences under clauses (a), (b) and (c) has been committed, knowing or having reason to believe the commission of such offence; or (e) wilfully destroys or damages any property of the Government entrusted to him; or (f) does any other thing with intent to defraud or to cause wrongful gain to one person or wrongful loss to another person. shall, on conviction by a Coast Guard Court, be liable to suffer imprisonment for a term which may extend to ten years or such less punishment as is in this Act mentioned.

Title: Variation of Maintenance Allowances

Where a displaced debtor has been ordered to pay an allowance periodically to any person for his maintenance under any decree or order of a court, or is liable to pay such allowance under any agreement voluntarily entered into, the rate at which such allowance is payable may be varied by the Tribunal on application made to it in his behalf, if the Tribunal thinks that such variation is necessary, and such variation shall have effect for such period as the Tribunal may direct, notwithstanding anything in any decree, order or agreement to the contrary.

Title: Appeals

(1) any person aggrieved by any decree or order of a court passed under this Act may, in such manner as may be prescribed, prefer an appeal- (a) to the court of the senior subordinate judge, if any, where the value of the case does not exceed two thousand rupees: Provided that here there is no senior subordinate judge, the appeal shall lie to the district judge; (b) to the court of the district judge, where the value of the case exceeds two thousand rupees but does not exceed ten thousand rupees; and (c) to the High Court, where the value of the case exceeds ten thousand rupees. (2) No second appeal shall lie from any decree or order passed in any case under this Act.

The Chairperson of the Appellate Tribunal and every Member of the Appellate Tribunal shall hold office as such for a term of five years from the date on which he enters upon his office: Provided that no Chairperson of the Appellate Tribunal or Member of the Appellate Tribunal shall hold office as such after he has attained, -- (a) In the case of the Chairperson of the Appellate Tribunal, the age of seventy years; (b) In the case of any Member of the Appellate Tribunal, the age of sixty-five years.
