Government of India Act, 1935 [Repealed] Section 304

Title: Persons Acting as Governor-general or Governor

State: Central

Year: 1935

Any person appointed by His Majesty to act as Governor-General or as the Governor of a Province during the absence of the Governor-General or the Governor from India, or during any period during which the Governor-General or the Governor is for any reason unable to perform the duties of his office shall during, and in respect of, the period while he is so acting have all the powers and immunities, and be subject to all the duties of, the Governor-General or Governor, as the case may be, and, if he holds any other office,_ shall not act therein or be entitled to the salary and allowances appertaining thereto while he is acting as Governor-General or Governor.

Cantonments Act, 2006 Section 304

Whoever- (a) fails to comply with an order issued under this Chapter within the period specified therein or whilst an order prohibiting him from re-entering a cantonment without permission is in force, re-enters the cantonment without such permission; or (b) knowing that any person has, under this Chapter been required to remove from the cantonment and has not obtained the requisite permission to re-enter it, harboure or conceals such person in the cantonment, shall be punishable with fine which may extend to five thousand rupees and in case of continuing offence with an additional fine which may extend to five hundred rupees for every day after the first during which he has persisted in the offence.

Title: Liability of Executor of His Own Wrong

Title: Restriction on the Power to Sanction Construction of a Place of Entertainment in Certain Cases

.....an orphanage containing one hundred or more inmates; or (b) in any thickly populated residential area which is either exclusively residential or reserved or used generally for residential as distinguished from business purposes; or (c) in any area reserved for residential purposes by any housing or planning scheme or otherwise under any enactment: Provided that no permission to construct any building intended to be used for cinematograph exhibition shall be given unless the standing committee is satisfied that sanction to the plans and specifications have been obtained in accordance with the Karnataka Cinemas (Regulation) Act, 1964 (Karnataka Act 23 of 1964) and the rules made thereunder.

Title: Punishment for Culpable Homicide Not Amounting to Murder

Whoever commits culpable homicide not amounting to murder shall be punished with 1 [imprisonment for life], or imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine, if the act by which me death is caused is done with the intention of causing death, or of causing such bodily injury as is likely to cause death; or with imprisonment of either description for a term which may extend to ten years, or with fine, or with both, if the act is done with the knowledge that it is likely to cause death, but without any intention to cause death, or to cause such bodily injury as is likely to cause death. _____________________ 1. New Delhi Municipal Council Act 1994 Section 304

Title: Disposal of Dead Animals

Whenever any animal in the charge of any person dies, the person in charge thereof shall within twenty-four hours either-- (a) convey the carcass to a place provided or appointed under section 263 for the final disposal of the carcasses of dead animals; or (b) give notice of the death to the Chairperson whereupon he shall cause the carcass to be disposed of on such fee as may be prescribed by the Council.

Code of Criminal Procedure, 1973 Section 304

Title: Legal Aid to Accused at State Expense in Certain Cases

State: Central

Year: 1973

(1) Where, in a trial before the Court of Session, the accused is not represented by a pleader, and where it appears to the Court that the accused has not sufficient means to engage a pleader, the Court shall assign a pleader for his defence at the expense of the State. (2) The High Court may, with the previous approval of the State Government make rule providing for (a) the mode of selecting pleaders for defence under sub-section (1); (b) the facilities to be allowed to such pleaders by the Courts; (c) the fee payable to such pleaders by the Government, and generally, for carrying out the purposes of sub-section (1). (3) The State Government may, by notification, direct that, as from such date as may be specified in the notification, the provisions of sub-sections (1) and (2) shall apply in relation to any class of trials before other Courts in the State as they apply in relation to trials before the Courts of Session.

.....its direction; (b) to call for any extract from the proceedings of any municipal councilor of any committee, or for any book or document in the possession of or under the control of a municipal council, and any return, statement, account, or report which he may think fit to require such municipal council to furnish; (c) to require any information or explanation which an auditor can require under sub-section (1) of section 291; (d) to require a municipal council to take into its consideration any objection which appears to him to exist to the doing of anything which is about to be done or is being done by such municipal council or any information which he is able to furnish and which appears to him to necessitate the doing of a certain thing by the municipal council, and to make a written replay to him within a reasonable time stating its reasons for not desisting from doing, or for not doing, such thing.
