Title : Commutation of Sentence of Imprisonment for Life

In every case in which sentence of 1 [imprisonment] for life shall have been passed, 2 [the appropriate Government] may, without the consent of the offender, commute the punishment for imprisonment of either description for a term not exceeding fourteen years. _____________________ 1. Substituted by Act 26 of 1955, section 117 and Schedule, for "transportation" (w.e.f. 1-1-1956). 2. Substituted by the A.O. 1950, for "the Provincial Government of the Province within which the offender shall have been sentenced". The words in italics were Substituted by the A.O. 1937, for "the Government of India or the Government of the place".

Title : Appointment of Places for Confinement of Persons Under Sentence of Imprisonment for Life and Removal Thereto

Section 10 - Appointment of places for confinement of persons under sentence of imprisonment for life and removal thereto (1) The State Government may appoint places within the1[State of Karnataka] to which persons under sentence of imprisonment for life shall be sent; and the State Government or any officer duly authorised in this behalf by the State Government shall give orders for the removal of such person to the place so appointed, except when sentence of imprisonment for life is passed on a person already undergoing imprisonment for life under a sentence previously passed for another offence. (2) In any case in which the State Government is competent under sub--section (1) to appoint places within the State and to order the removal thereto of persons under sentence of imprisonment for life, the State Government may appoint such places in any other State by agreement with the Government of such State and may, by like agreement, give orders or duly authorise any officer to give orders for the removal thereto of such persons. ______________________________________ 1. Title : Sentence of Imprisonment for Non-payment of Fine

1 [In every case, of an offence punishable with imprisonment as well as fine, in which the offender is sentenced to a fine, whether with or without imprisonment, and in every case of an offence punishable 2 [with imprisonment or fine, or] with fine only, in which the offender is sentenced to a fine,] it shall be competent to the Court which sentences such offender to direct by the sentence that, in default of payment of the fine, the offender shall suffer imprisonment for a certain term, in which imprisonment shall be in excess of any other imprisonment to which he may have been sentenced or to which he may be liable under a commutation of a sentence. _____________________ 1. Karnataka Prisons Act, 1963 Section 61

Title : Confinement in Irons of Prisoners Under Sentence of Imprisonment for Life

(1) Prisoners under sentence of imprisonment for life may, subject to such conditions as may be prescribed, be confined, in fetters for the first three months after admission to prison. (2) Should the Superintendent consider it necessary either for the safe custody of the prisoner himself or for any other reason that fetters should be retained on any such prisoner for more than three months, he shall apply to the Inspector-General for sanction to their retention for such period as may be necessary, and the Inspector-General may sanction such retention accordingly.

Code of Criminal Procedure, 1973 Section 30

Title : Sentence of Imprisonment in Default of Fine

Year : 1973

(1) The Court of a Magistrate may award such term of imprisonment in default of payment of fine as is authorised by law: Provided that the term (a) is not in excess of the powers of the Magistrate under section 29; (b) shall not, where imprisonment has been awarded as part of the substantive sentence, exceed one-fourth of the term of imprisonment which the Magistrate is competent to inflict as punishment for the offence otherwise than as imprisonment in default of payment of the fine. (2) The imprisonment awarded under this section may be in addition to a substantive sentence of imprisonment for the maximum term awardable by the Magistrate under section 29.

Title : Sentence on Offender Already Sentenced for Another Offence

.....conviction to imprisonment for a term or imprisonment for life, the subsequent sentence shall run concurrently with such previous sentence. STATE AMENDMENT 1Tamil Nadu: In section 247 after sub-section (1), the following sub-section shall be inserted, namely:- "(1A) Notwithstanding anything contained in sub-section (1), when a person already undergoing a sentence of imprisonment is sentenced on a subsequent conviction to imprisonment under sub-section (2) of section 380 of the Indian Penal Code (Central Act XLV of 1860), for an offence of theft of any idol or icon in any building used as a place of worship, such imprisonment shall commence ac the expiration of the imprisonment to which he has been previously sentenced." ______________________ 1. The appropriate Government may, without the consent of the person sentenced commute (a) a sentence of death, for any other punishment provided by the Indian Penal Code (45 of 1860); (b) a sentence of imprisonment for life, for imprisonment for a term not exceeding fourteen years or for fine; (c) a sentence of rigorous imprisonment for simple imprisonment for any term to which that person might have been sentenced, or for fine; (d) a sentence of simple imprisonment, for fine.

Indian Penal Code (45 of 1860) Section 60

Title : Sentence May Be (in Certain Cases of Imprisonment) Wholly or Partly Rigorous or Simple

In every ease in which an offender is punishable with imprisonment which may be of either description, it shall be competent to the Court which sentences such offender to direct in the sentence that such imprisonment shall be wholly rigorous, or that such imprisonment shall be wholly simple, or that any part of such imprisonment shall be rigorous and the rest simple.
