Title: Amendment of Section 252

State: Central

Year: 2002

In section 252 of the Income-tax Act, for sub-section (3), the following sub-section shall be substituted, namely:-- "(3) The Central Government shall appoint the Senior Vice-President or one of the Vice-Presidents of the Appellate Tribunal to be the President thereof".

In section 252 of the Income-tax Act,-- (a) in sub-section (2),-- (i) for the words "Central legal Service", the words "Indian Legal Service" shall be substituted; (ii) for the word and figure "Grade I", the word and figures "Grade II" shall be substituted; (b) in sub-section (2A), for the words "Commissioner of Income-tax", the words." Additional Commissioner of Income-tax" shall be substituted.

Title: Amendment of Section 252

In section 252 of the Income-tax Act, after sub-section (3), the following sub-section shall be inserted, namely :- "(4) The Central Government may appoint one or more members of the Appellate Tribunal to be the vice-president or, as the case may be, vice-presidents thereof. (5) A vice-president shall exercise such of the powers and perform such of the functions of the president as may be delegated to him by the president by a general or special order in writing.".

In section 252 of the Income-tax Act, for sub-section (2), the following sub-section shall be substituted, namely :- "(2) A judicial member shall be a person who has for at least ten years held a judicial office in the territory of India or who has been a member of the Central Legal Service and has held a post in Grade I of that Service or any equivalent or higher post for at least three years or who has been an advocate for at least ten years. Explanation : For the purposes of this sub-section, - (i) in computing the period during which a person has held judicial office in the territory of India, there shall be included any period, after he has held any judicial office, during which the person has been an advocate or has held the office of a member of a tribunal or any post, under the Union or a State, requiring special knowledge of law; (ii) in computing the period during which a person has been an advocate, there shall be included any period during which the person has held judicial office or the office of a member of a tribunal or any post, under the Union or State, requiring special knowledge of law after he became an advocate. .....First Offenders Probation Act, 1938 (U.P. Act VI of 1938), and the Uttar Pradesh Children Act, 1951 (U.P. Act 1 of 1951) shall continue in force in the State of Uttar Pradesh until altered or repealed or amended by the competent Legislature or other competent authority, and accordingly, the provisions of section 360 of this case shall not apply to that State, and the provisions of section 361 shall apply with the substitution of references to the Central Act named therein by references to the corresponding Acts in force in the State." ______________________ 1. Indian Penal Code (45 of 1860) Section 252

Title: Possession of Coin by Person Who Knew It to Be Altered when He Became Possessed Thereof

State: Central

Year: 1860

Whoever, fraudulently or with intent that fraud may be committed, is in possession of coin with respect to which the offence defined in cither of the section 246 or 248 has been committed, having known at the time of becoming possessed thereof that such offence had been committed with respect to such coin, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.

Code of Criminal Procedure, 1973 Section 254

Title: Procedure when Not Convicted

State: Central

Year: 1973

(1) If the Magistrate does not convict the accused under section 252 or section 253, the Magistrate shall proceed to hear the prosecution and take all such evidence as may be produced in support of the prosecution, and also to hear the accused and take all such evidence as he produces in his defence. (2) The Magistrate may, if he thinks fit, on the application of the prosecution or the accused, issue a summons to any witness directing him to attend or to produce any document or other thing. (3) A Magistrate may, before summoning any witness on such application, require that the reasonable expenses of the witness incurred in attending for the purposes of the trial be deposited in Court.

Code of Criminal Procedure, 1973 Section 255

Title: Acquittal or Conviction

State: Central

Year: 1973

(1) If the Magistrate, upon taking the evidence referred to in section 254 and such further evidence, if any, as he may, of his own motion, cause to be produced, finds the accused not guilt, he shall record an order of acquittal. (2) Where the Magistrate does not proceed in accordance with the provisions of section 325 or section 360, he shall, if he finds the accused guilty, pass sentence upon him according to law. (3) A Magistrate may, under section 252 or section 255, convict the accused of any offence triable under this Chapter which form the facts admitted or proved he appears to have committed, whatever may be the nature of the complaint or summons, if the Magistrate is satisfied that the accused would not be prejudiced thereby.
