Indian Penal Code (45 of 1860) Section 208

Title: Fraudulently Suffering Decree for Sum Not Due

State: Central

Year: 1860

Whoever fraudulently causes or suffers a decree or order to be passed against him at the suit of any person for a sum not due or for a larger sum that is due to such person or for any property or interest in property to which such person is not entitled, or fraudulently causes or suffers a decree or order to be executed against him after it has been satisfied, or for anything in respect of which it has been satisfied, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both. Illustration A institutes a suit against Z. Z knowing that A is likely to obtain a decree against him, fraudulently suffers a judgment to pass against him for a larger amount at the suit of B, who has no just claim against him, in order that B, either on his own account or for the benefit of Z, may share in the proceeds of any sale of Z's property which may be made under A's decree. Z has committed an offence under this section.

Indian Contract Act, 1872 Section 208

Title: When Termination of Agents Authority Takes Effect as to Agent and as to Third Persons

.....A afterwards, by letter, revokes B's authority. B after the letter is sent, but before he receives it, sells the goods for 100 rupees. The sale is binding on A, and B is entitled to five rupees as his commission. (b) A, at Madras, by letter, directs B to sell for him some cotton lying in a warehouse in Bombay, and afterwards, by letter, revokes his authority to sell, and directs B to send the cotton to Madras. B, after receiving the second letter, enters into a contract with C, who knows of the first letter, but not of the second, for the sale to him of the cotton. C pays B the money, with which B absconds. C's payment is good as against A. (c) A directs B, his agent, to pay certain money to C. A dies, and D takes out probate to his will. B, after A's death, but before hearing of it, pays the money to C. The payment is good as against D, the executor.

Government of India Act, 1935 [Repealed] Section 208

Title: Appeals to His Majesty in Council

An appeal may be brought to His Majesty in Council from a decision of the Federal Court-- (a) from any judgment of the Federal Court given in the exercise of its original jurisdiction in any dispute which concerns the interpretion of this Act or of an Order in Council made there under,1[or] the extent of the legislative or executive authority vested in the Federation by virtue of the Instrument of Accession of any State, or arises under an agreement made under Part VI of this Act in relation to the administration in any State of a law of the Federal Legislature, without leave; and (c) in any other case, by leave of the Federal Court or of His Majesty in Council. ________________________ 1. Companies Act, 1956 Section 208

Title: Power of Company to Pay Interest out of Capital in Certain Cases

.....be determined by the Central Government; and that period shall in no case extend beyond the close of the half-year next after the half-year during which the work or building has been actually completed or the plant provided. (6) The rate of interest shall in no case except four per cent per annum or such other rate as the Central Government may, by notification in the Official Gazette, direct. (7) The payment of the interest shall not operate as a reduction of the amount paid up on the shares in respect of which it is paid. (8) Nothing in this section shall affect any company to which the Indian Railway Companies Act, 1895 (10 of 1895), or the Indian Tramways Act, 1902 (4 of 1902) applies .

Merchant Shipping Act, 1958 Section 208

Title: On Change of Master, Documents to Be Handed over to Successor

(1) If during the progress of a voyage the master of any Indian ship is removed or superseded or for any other reason quits the ship and is succeeded in the command by some other person, he shall deliver to his successor the various documents relating to the navigation of the ship and the crew thereof which are in his custody. (2) Such successor shall immediately on assuming the command of the ship enter in the official log book a list of the documents so delivered to him.

Karnataka Municipalities Act, 1964 Section 208

Title: Permission Necessary for Certain Projections

Code of Criminal Procedure, 1973 Section 208

Title: Supply of Copies of Statements and Documents to Accused in Other Cases Triable by Court of Session

Where, in a case instituted otherwise than on a police report, it appears to the Magistrate issuing process under section 204 that the offence is triable exclusively by the Court of Session, the Magistrate shall without delay furnish to the accused, free of cost, a copy of each of the following: (i) the statements recorded under section 200 or section 202, or all persons examined by the Magistrate; (ii) the statements and confessions, if any, recorded under section 161 or section 164; (iii) any documents produced before the Magistrate on which the prosecution proposes to rely: Provided that if the Magistrate is satisfied that any such document is voluminous, he shall, instead of furnishing the accused with a copy thereof, direct that he will only be allowed to inspect it either personally or through pleader in Court.
