Title: Carriers Not to Be Liable for Loss of Certain Goods Above One Hundred Rupees in Value, Unless Delivered as Such

No common carrier shall be liable for the loss of or damage to property delivered to him to be carried exceeding in value one hundred rupees and of the description contained in the Schedule to this Act, unless the person delivering such property to be carried, or some person duly authorised in that behalf, shall have expressly declared to such carrier or his agent the value and description thereof.

Title: For Carrying Such Property Payment May Be Required at Rates Fixed by Carrier

Every such carrier may require payment for the risk undertaken in carrying property exceeding in value one hundred rupees and of the description aforesaid, at such rate of charge as he may fix: Provided that, to entitle such carrier to payment at a rate higher than his ordinary rate of charge, he shall have caused to be exhibited in the place where he carries on the business of receiving property to be carried, notice of the higher rate of charge required, printed or written in English and in the vernacular language of the country wherein he carries on such business.

Carriers Act, 1865 Section 5

Title: The Person Entitled to Recover in Respect of Property Lost or Damaged May Also Recover Money Paid for Its Carriage

In case of the loss or damage to property exceeding in value one hundred rupees and of the description aforesaid, delivered to such carrier to be carried, when the value and description thereof shall have been declared and payment shall have been required in manner provided for by this Act, the person entitled to recover in respect of such loss or damage shall also be entitled to recover any money actually paid to such carrier in consideration of such risk as aforesaid.

Title: State Government to Add to the Schedule

State: Central

Year: 1865

The State Government may, by notification in the Official Gazette, add to the list of articles contained in the Schedule to this Act, and the Schedule shall, on the issue of any such notification, be deemed to have been amended accordingly.

Act for Avoiding Wagers (Amendment) Act, 1865, (Maharashtra) Section 1

Title: Contracts Declared Null and Void. No Suit Allowed on Such Contracts

All contracts, whether by speaking, writing or otherwise, knowingly made to further or assist the entering into, effecting or carrying out agreements by way of gaming or wagering and all contracts by way of security or guarantee for the performance of such agreements or contracts shall be null and void; and no suit shall be allowed in any Court of Justice for recovering any sum of money paid or payable in respect of any such contract or contracts, or any such agreement or agreements as aforesaid.

Title: nor for Commission or Brokerage, Etc., in Respect of Agreements by Way of Gaming or Wagering

No suit shall be allowed in any Court of Justice for recovering any commission, brokerage, fee or reward in respect of the knowingly effecting or carrying out, or of the knowingly aiding in effecting or in carrying out, or otherwise claimed or claimable in respect of, any such agreement by way of gaming or wagering or any such contract as aforesaid, whether the plaintiff in such suit be or be not a party to such last mentioned agreement or contract, or for recovering any sum of money knowingly paid or payable on account of any persons by way of commission, brokerage, fee or reward in respect of any such agreement by way of gaming or wagering or contract as aforesaid.

Title: Repeal and Savings

1[The Act for Avoiding Wagers (Amendment) Act, 1865, as applied to the Kutch area of the State of Bombay by the Kutch (Application of Laws) Order, 1949, is hereby repealed : Provided that such repeal shall not affect -- (a) the previous operation of the Act so repealed or anything duly done or suffered thereunder; (b) any right, privilege, obligation or liability acquired, accrued or incurred under the Act so repealed; or (c) any legal proceeding or remedy in respect of any such right, privilege, obligation or liability as aforesaid, and any such legal proceeding or remedy may be instituted, continued or enforced as if the Bombay Act for Avoiding Wagers (Extension and Amendment) Act, 1959, had not been passed.] _____________ 1. Section 4 was inserted by Bom. 21 of 1959, Section 4(c).

Title: Notice of Loss or Injury to Be Given Within Six Months

No suit shall be instituted against a common carrier for the loss of, or injury to 1[goods including container, pallets or similar article of transport used to consolidate goods) entrusted] to him for carriage, unless notice in writing of the loss or injury has been given to him before the institution of the suit and within six months of the time when the loss or injury first came to the knowledge of the plaintiff. _____________________ 1.
