Title: Existing Contracts of Secretary of State in Council

.....the commencement of Part III of this Act be purposes of the Government of a Province, have effect as if it had been made in behalf of that Province; and (b) in any other case have effect as if it had been made on behalf of the Federation, and references in any such contract to the Secretary of State in Council shall be construed accordingly, and any such contract may be enforced in accordance with the provisions of the next but one succeeding section. (2) This section does not apply in relation to contracts solely in connection with the affairs of Burma or Aden, or solely for purposes which will after the commencement of Part III of this Act be purposes of His Majesty's Representative for the exercise of the functions of the Crown in its relationswith Indian States. ________________________ 1. Title: Disposal of Infectious Corpse

Where any person has died in a cantonment from any infectious or contagious disease, the Chief Executive Officer, may, by notice in writing,-- (a) require any person having charge of the corpse to convey the same to a mortuary, thereafter to be disposed of in accordance with law; or (b) prohibit the removal of the corpse from the place where death occurred except for the purpose of being buried or burned or of being conveyed to a mortuary.

Title: Power to Declare Any Street a Public Street Subject to Objections by Owners

A municipal council may, at any time, by notice fixed up in any street or part of a street not maintainable by the municipal council give intimation of its intention to declare the same to be public street, and unless within one month next after such notice has been so put up, the owner or the majority of several owners of such street or such part of a street, lodges or lodge objections thereto at the municipal office, the municipal council may, by notice in writing put up in such street, or such parts, declare the same to be a public street.

If, on the expiration of ninety days from the date of sale of any immoveable property, no application has been made for setting aside the sale or if any such application has been made and rejected, the Deputy Commissioner shall make an order confirming the sale: Provided that for reasons to be recorded, the Deputy Commissioner may set aside the sale subject to such conditions as he may deem proper, notwithstanding that no application therefor has been made, or on grounds other than those alleged in any application which has been made and rejected.

Any immovable property which any municipal authority is authorised by this Act to acquire may be acquired under the provisions of the Land Acquisition Act, 1894, and on payment of the compensation awarded under the said Act in respect of such property and of any other charges incurred in acquiring it, the said property shall vest in the corporation.

Title: Persons Interested May Apply to Government to Annul, Reverse or Alter Any Order

In the case of any rule or order made by the Government under an authority conferred by this Act and requiring the public or a particular class of persons to perform some duty or act, or to conduct or order themselves or those under their control in a manner therein described, it shall be competent to any person interested to apply to the Government, to annul, reverse or alter the rule or order aforesaid on the ground of its being unlawful, oppressive or unreasonable. (2) After such an application as aforesaid and the rejection thereof wholly or in part or after the lapse of six months without an answer to such application or a decision thereon published by the Government, it shall be competent to the person interested and deeming the rule or order contrary to law to institute a suit against the State for a declaration that the rule or order is unlawful either wholly or in part. The decision in such suit shall be subject to appeal; and a rule or order finally adjudged to be unlawful shall by the Government be annulled or reversed or so altered as to make it conformable to law.

Title: Removal to Hospital of Patient Suffering from Infectious Disease

In any municipality when any person suffering from any infectious disease is found to be-- (a) without proper lodging or accommodation, or (b) living in a Serai or other public hostel, or (c) living in a room or house which neither he nor any one, of whom he is a dependent, either own or pays rent for, the Nagar Panchayat or, as the case may be the Council, by any persons authorised by it in this behalf may, on the advice of an Assistant Surgeon, remove the patient to any hospital or place at which persons suffering from such diseases are received for medical treatment and may do anything necessary for such removal.

Whoever contravenes any provision of this Act or of any rule, regulation or notification made thereunder shall, if no penalty is provided for the offence be punishable for the first offence with fine which may extend to one hundred rupees, and for any second or subsequent offence with fine which may extend to three hundred rupees.
