Title: Application of This Act to Lands Held on Inami, Fazindari and Special Tenures and Application of Chapter Xiv of Code

State: Maharashtra

Year: 1969

(1) Save as expressly provided in this Act, the provisions of this Act shall apply to lands held on inami tenure as Fazindari land or on special tenure as entered in the registers and rent rolls maintained under section 305 of the Code. (2) The provisions of Chapter XIV of the Code (inclusive of the modifications specified in the Second Schedule) shall apply to the said lands in so far as they are not inconsistent with the provisions of this Act.

In section 2 of the Code of Criminal Procedure, 1973(2 of 1974) (hereinafter referred to as the principal Act), after clause (w), the following clause shall be inserted, namely:-- '(wa) "victim" means a person who has suffered any loss or injury caused by reason of the act or omission for which the accused person has been charged and the expression "victim" includes his or her guardian or legal heir;'.

Title: Amendment of the Code of Civil Procedure (Amendment) Act, 1999

.....of Civil Procedure (Amendment) Act, 2002, shall not apply to in respect of any proceedings pending before the commencement of section 15 of this Act and section 6 of the Code of Civil Procedure (Amendment) Act, 2002;"; (iii) for clause (k), the following clause shall be substituted, namely:-- "(k) the provisions of rules 9,11,14,15 and 18 of Order VII of the first Schedule as amended or, as the case may be, substituted or omitted by section 17 of this Act and by section 8 of the Code of Civil Procedure (Amendment) Act, 2002, shall not apply to in respect of any proceedings pending before the commencement of section 17 of this Act and section 8 of the Code of Civil Procedure (Amendment) Act, 2002;"; (iv) for clause (1), the following clause shall be substituted, namely:-- "(1) the provisions of rules 1, 1A, 8 A, 9 and 10 of Order VIII of the First Schedule as substituted or, as the case may be, inserted or omitted by section 18 of this Act and by section 9 of the Code of Civil Procedure (Amendment) Act, 2002, shall not apply to a written statement filed and presented before the commencement of section 18 of this Act and section 9 of the Code of Civil Procedure.....

Indian Penal Code (45 of 1860) Section 472

Title: Making or Possessing Counterfeit Seal, Etc., with Intent to Commit Forgery Punishable Under Section 467

Whoever makes or counterfeits any seal, plate or other instrument for making an impression, intending that the same shall be used for the purpose of committing any forgery which would be punishable under section 467 of this Code, or, with such intent, has in his possession any such seal, plate or other instrument, knowing the same to be counterfeit, shall be punished with1[imprisonment for life], or with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine. ________________________ 1. Title: Counterfeiting Device or Mark Used for Authenticating Documents Described in Section 467, or Possessing Counterfeit Marked Material

Whoever counterfeits upon, or in the substance of, any material, any device or mark used for the purpose of authenticating any document described in Section 467 of this Code, intending that such device or mark shall be used for the purpose of giving the appearance of authenticity to any document then forged or thereafter to be forged on such material, or who, with such intent, has in his possession any material upon or in the substance of which any such device or mark has been counterfeited, shall be punished with1[imprisonment for life], or with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine. ________________________ 1. Title: Non-appearance in Response to a Proclamation Under Section 82 of Act 2 of 1974

1[Whoever fails to appear at the specified place and the specified time as required by a proclamation published under sub-section (1) of Section 82 of the Code of Criminal Procedure, 1973 shall be punished with imprisonment for a term which may extend to three years or with fine or with both, and where a declaration has been made under sub-section (4) of that section pronouncing him as a proclaimed offender, he shall be punished with imprisonment for a term which may extend to seven years and shall also be liable to fine.] _________________________ 1. Title: Insertion of New Section 16

In the Court Fees' Act, 1870 (7 of 1870) (hereafter in this Chapter referred to as the Court Fees' Act), after section 15, the following section shall be inserted, namely: -- "16. Refund of fee.--Where the Court refers the parties to the suit to any one of the mode of settlement of dispute referred to in section 89 of the Code of Civil Procedure, 1908 (5 of 1908) the plaintiff shall be entitled to a certificate from the Court authorising him to receive back from the collector, the full amount of the fee paid in respect of such plaint.".
