Cost and Works Accountants Act, 1959 Section 3

Title: Incorporation of the Institute

State: Central

Year: 1959

(1) All persons whose names are entered in the Register at the commencement of this Act and all persons who may hereafter have their names entered in the Register under the provisions of this Act, so long as they continue to have their names borne on the said Register, are hereby constituted a body corporate by the name of the Institute of Cost and Works Accountants of India, and all such persons shall be known as members of the Institute. (2) The Institute shall have perpetual succession and a common seal, and shall have bower to acquire, hold and dispose of property, both moveable and immovable, and shall by its name sue or be sued.

Haj Committee Act, 1959 [Repealed] Section 2

In this Act, unless the context otherwise requires,--- (a) "Committee" means the Haj Committee constituted under this Act; (b) "pilgrim" means a Muslim proceeding on or returning from pilgrimage to Saudi Arabia, Syria, Iraq, Iran or Jordan; (c) "pilgrim ship" means a ship conveying or about to convey pilgrims from or to the port of Bombay to or from any port in the Read Sea other than Suez; (d) "prescribed" means prescribed by rules made under this Act.

Title: Declaration of the Indian Statistical Institute as an Institution of National Importance

Whereas the objects of the institution known as the Indian Statistical Institute are such as to make it an institution of national importance, it is hereby declared that the Indian Statistical Institute is an institution of national importance.

Title: Definitions

In this Act, unless the context otherwise requires.-- (a) "Institute" means the Indian Statistical Institute registered under the Societies Registration Act, 1860. (b) "memorandum" means the memorandum of association of the Institute filed with the Registrar of Joint-Stock Companies under the Societies Registration Act. 1860; (c) "rules and regulations" includes any rule or regulation (by whatever name called) which the Institute is competent to make in the exercise of the powers conferred on it under the Societies Registration Act, 1860, but shall not include any bye-laws or standing orders made under the rules and regulations for the conduct of its day-to-day administration.

Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959 Section 9

Title: Protection of Action Taken in Good Faith

No suit, prosecution or other legal proceeding shall lie against any person for anything which is in good faith done or intended to be done under this Act.

No prosecution for an offence under this Act shall be instituted except by, or with the sanction of, such officer of Government as may be prescribed in this behalf or any person authorised by that officer in writing.

Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959 Section 5

Title: Employers to Furnish Information and Returns in Prescribed Form

State: Central

Year: 1959

(1) After the commencement of this Act in any State or area thereof, the employer in every establishment in public sector in that State or area shall furnish such information or return as may be prescribed in relation to vacancies that have occurred or are about to occur in that establishment, to such employment exchanges as may be prescribed. (2) The appropriate Government may, by notification in the Official Gazette, require that from such date as may be specified in the notification, the employer in every establishment in private sector or every establishment pertaining to any class or category of establishments in private sector shall furnish such information or return as may be prescribed in relation to vacancies that have occurred or are about to occur in that establishment to such employment exchanges as may be prescribed, and the employer shall thereupon comply with such requisition. (3) The form in which, and the intervals of time at which, such information or return shall be furnished and the particulars which they shall contain shall be such as may be prescribed.

Haj Committee Act, 1959 [Repealed] Section 19

Title: Repeal and Savings

State: Central

(1) The Port Haj Committees Act, 1932 (20 of 1932.), is hereby repealed. (2) Notwithstanding such repeal, the Port Haj Committee of Bombay constituted under the said Act shall, until the establishment of the Committee under this Act, continue to function as if this Act had not been passed and on such establishment of the Committee, the Port Haj Committee of Bombay shall stand dissolved.

Title: Vacancies, Etc., Not to Invalidate Acts or Proceedings of the Committee

No act or proceeding of the Committee shall be invalid by reason only of the existence of any vacancy among its members or any defect in the constitution thereof.

Haj Committee Act, 1959 [Repealed] Section 10

Title: Meetings of Committee

State: Central

Year: 1959

(1) The Committee shall meet at least once in every month during the four months before the Haj Day and during the two months after the Haj Day, and at least once in three months during the rest of the year. (2) The number of members required to make a quorum at any meeting shall be six. (3) All matters shall be decided by a majority of votes of the members present, and in the event of an equality of votes the Chairman or other person presiding shall have a casting vote.
