In section 135 of the principal Act,-- (A) for sub-section (1), the following sub-sections shall be substituted, namely:-- "(1) Whoever, dishonestly,-- (a) taps, makes or causes to be made any connection with overhead, underground or under water lines or cables, or service wires, or service facilities of a licensee or supplier, as the case may be; or (b) tampers a meter, installs or uses a tampered meter, current reversing transformer, loop connection or any other device or method which interferes with accurate or proper registration, calibration or metering of electric current or otherwise results in a manner whereby electricity is stolen or wasted; or (c) damages or destroys an electric meter, apparatus, equipment, or wire or causes or allows any of them to be so damaged or destroyed as to interfere with the proper or accurate metering of electricity; or (d) uses electricity through a tampered meter; or (e) uses electricity for the purpose other than for which the usage of electricity was authorised, so as to abstract or consume or use electricity shall be punishable with imprisonment for a term which may extend to three years or with fine or with both: .....

In section 135 of the Customs Act, in sub-section (1),- (a) in clause (a), after the words "knowingly concerned", the words "in mis-declaration of value or" shall be inserted; (b) in clause (b), for the word and figures "section 111,", the words and figures "section 111 or section 113, as the case may be, or" shall be substituted; (c) after clause (b), the following clause shall be inserted, namely:- "(c) attempts to export any goods which he knows or has reason to believe are liable to confiscation under section 113,".

In section 135 of the Customs Act, for sub-section (1), the following sub-section shall be substituted, namely:-- "(1) Without prejudice to any action that may be taken under this Act, if any person-- (a) is in relation to any goods in any way knowingly concerned in misdeclaration of value or in any fraudulent evasion or attempt at evasion of any duty chargeable thereon or of any prohibition for the time being imposed under this Act or any other law for the time being in force with respect to such goods; or (b) acquires possession of or is in any way concerned in carrying, removing, depositing, harbouring, keeping, concealing, selling or purchasing or in any other manner dealing with any goods which he knows or has reason to believe are liable to confiscation under section 111 or section 113, as the case may be; or (c) attempts to export any goods which he knows or has reason to believe are liable to confiscation under section 113; or (d) fraudulently avails of or attempts to avail of drawback or any exemption from duty provided under this Act in connection with export of goods, he shall be punishable, -- (i) in the case of an offence relating to,-- (A) any goods.....

Section 135 - Resignation of members A member of a Taluk Panchayat may resign his membership in writing under his hand addressed to the Adhyaksha of the Taluk Panchayat and his seat shall become vacant on the expiry of fifteen clear days from the date of such resignation unless within the said period of fifteen days, he withdraws such resignation by writing under his hand addressed to the Adhyaksha.1[The Adhyaksha shall cause the letter of resignation to be laid in the next meeting of the Taluk Panchayat.] _____________________ 1. After section 104 of the Customs Act, the following section shall be inserted, namely:-- "104A. Bail for offence punishable for a term of imprisonment of three years or more under section 135 not to be granted without hearing public prosecutor.-- (1) Notwithstanding anything contained in the Code of Criminal Procedure, 1973(2 of 1974), no person accused of an offence punishable for a term of imprisonment of three years or more under section 135 shall be released on bail or on his own bond unless-- (i) the public prosecutor has been given an opportunity to oppose the application for such release; and (ii) where the public prosecutor opposes the application, the Magistrate is satisfied that there are reasonable grounds for believing that he is not guilty of such offence and that he is not likely to commit any offence while on bail: Provided that a person who is under the age of eighteen years or is a woman or is sick or infirm, may be released on bail if the Magistrate so directs. (2) Notwithstanding anything contained in the Code of Criminal Procedure, 1973(2 of 1974), no police officer shall, save as otherwise provided under this Act, investigate into an offence under.....

In section 150 of the principal Act, after sub-section (2), the following shall be inserted, namely:-- '(3) Notwithstanding anything contained in sub-section (1) of section 135, subsection (1) of section 136, section 137 and section 138, the licence or certificate of competency or permit or such other authorisation issued under the rules made or deemed to have been made under this Act to any person who acting as an electrical contractor, supervisor or worker abets the commission of an offence punishable under sub-section (1) of section 135, sub-section (1) of section 136, section 137, or section 138, on his conviction for such abetment, may also be cancelled by the licensing authority: Provided that no order of such cancellation shall be made without giving such person an opportunity of being heard. Explanation.--For the purposes of this sub-section, "licensing authority" means the officer who for the time being in force is issuing or renewing such licence or certificate of competency or permit or such other authorisation.'.
