(3) Summary assessment under sub-section (1) 1 [or sub-section (1A)] shall not be made in respect of a dealer for any year if,- (i) the return filed or any compliances furnished as required by sub-section (1) for any year is incomplete or incorrect or defective, save for mistakes apparent on record, (ii) it is found that the dealer attempted to conceal any turnover to evade tax, for that year and for subsequent two years, (iii) the dealer.....

National Commission for Minority Educational Institutions Act, 2004 Section 12C

Title: Power to Cancel

1[Section 12C - Power to cancel The Commission may, after giving a reasonable opportunity of being heard to a Minority Educational Institution to which minority status has been granted by an authority or Commission, as the case may be, cancel such status under the following circumstances, namely:-- (a) if the constitution, aims and objects of the educational institution, which has enabled it to obtain minority status has subsequently been amended in such a way that it no longer reflects the purpose or character of a Minority Educational Institution; (b) if, on verification of the records during the inspection or investigation, it is found that the Minority Educational Institution has failed to admit students belonging to the minority community in the institution as per rules and prescribed percentage governing admissions during any academic year.] __________________________ 1.Inserted by the National Commission for Minority Educational Institutions (Amendment) Act, 2006 (18 of 2006) w.e.f. 23.01.2006.

JURISDICTION ,POWERS AND PROCEDURE OF THE CORPORATION 1[12C. Enforcement of the order made by the Commission under section 12A or 12B. - Every order made by the Commission under section 12A granting a temporary injunction or under section 12B directing the owner of an undertaking or other person to make payment of any amount, may be enforced by the Commission in the same manner as if it were a decree or order made by a court in a suit pending therein and it shall be lawful for the Commission to send, in the event of its inability to execute it, such order to the court within the local limits, of whose jurisdiction,- (a) in the case of an order against a company, the registered office of the company is situated, or (b) in the case of an order against any other person, the place where the person concerned voluntarily resides or carries on business or personally works for gain, is situated, and thereupon the court to which the order is so sent shall execute the order as if it were a decree or order sent to it for execution.] ________________________ 1. National Commission for Minority Educational Institutions (Amendment) Act, 2006 Section 6

Title: Amendment of Bengal Act Vi of 1941 as in Force in Delhi

.....of Delhi, - (a) in section 5, in sub-section (2), in sub-clause (ii) of clause (a), for the words "for use by him, as raw materials in the manufacture of goods for sale; and", the following shall be substituted, namely :- "For use by him as raw materials in the manufacture in the Union territory of Delhi (hereafter in this sub-clause referred to as Delhi), of goods (other than goods declared tax-free under section 6), - (A) for sale inside Delhi; or (B) for sale in the course of inter-State trade or commerce, being a sale occasioning, or effected by transfer of documents of title to such goods during the movement of such goods from Delhi; or (C) for sale in the course of export outside India being a sale occasioning the movement of such goods from Delhi, or a sale effected by transfer of documents of title to such goods effected during the movement of such goods from Delhi, to a place outside India and after the goods have crossed the customs frontiers of India; and"; (b) after section 12, the following sections shall be inserted, namely :- 12A. National Commission for Minority Educational Institutions Act, 2004 Section 12B

Title: Power of Commission to Decide on the Minority Status of an Educational Institution

(4) On receipt of the appeal under sub-section (3), the Commission may, after giving the parties to the appeal an opportunity of being heard, and in consultation with the State Government, decide on the minority status of the educational institution and shall proceed to give such directions as it may deem fit and, all such directions shall be binding on the parties.
