Title : Amendment of Section 10 of Bom. Xxv of 1930

In section 10 of the principal Act, in sub-section (3), in the second proviso, for clauses (i) and (ii), the following clauses shall be substituted, namely:-- "(i) does not exceed five hundred rupees, the Joint Director, Local Fund Accounts Audit or the Assistant Director, Local Fund Accounts Audit; (ii) does not exceed one thousand rupees, the Director, Local Fund Accounts Audit, may, if he considers that it ought to be condoned, condone such defect or irregularity. On such condonation, however, the officer concerned shall make a note to that effect in his report.".

Title : Penalty for Contravention of Section 10

Year : 1985

Whoever, in relation to any specified class of goods, services, undertakings or users of weights or measures, uses in any transaction or for industrial production or for protection, any weight, measure or number, other than the weight, measure or number specified by rules made under section 10, shall be punished with fine which may extend to two thousand rupees, and, for the second or subsequent offence, with imprisonment for a term which may extend to one year and also with fine.

Title : Cessation of Powers Given by Order Under Section 10

State : Maharashtra

Year : 1955

If a promoter authorized by an order made under section 10 to construct an aerial ropeway does not within the time specified in the order -- (a) succeed in raising the full amount of capital required for the completion of such ropeway, or (b) substantially commence the construction of such ropeway, or (c) complete the construction thereof, the powers given to the promoter by such order shall, unless the State Government extends the time so specified, cease to be exercised.

Bombay Lotteries (Control and Tax) and Prize Competitions (Tax) Act, 1958, (Maharashtra) Section 12

Title : Calculation and Recovery of Tax Levied Under Section 10

State : Maharashtra

Year : 1958

(1) The amount of tax to be levied in respect of a lottery or prize competition under section 10 shall be calculated by the Collector on the total sum received or due in respect of the lottery or prize competition as disclosed in the accounts maintained and statements submitted to him or a declaration made before him under section 14. (2) In cases where no such accounts are maintained, or no such statements are submitted, or no such declaration is made, or where such accounts, statements or declaration are or is in the opinion of the Collector false or incorrect, the Collector shall make the calculation to the best of his judgment. (3) The tax leviable under section 10 shall in the case of each quarter and in the case of a lottery be paid within 30 days of the date on which such lottery is drawn. (4) If any tax payable under section 10 is in arrear the Collector may in lieu thereof, recover any sum not exceeding double the amount of the tax so unpaid or any smaller sum above the amount of the tax which the collector may think it reasonable to recover.

Title : Power for Local Authority to Give Permission Under Section 10, Clause (C), Subject to Conditions

Any permission given by a local authority under section 10, clause (c) may be given subject to such reasonable conditions as that authority thinks fit to impose, as to the payment of any expenses to which the authority will necessarily be put in consequence of the exercise of the powers conferred by that section, or as to the time or mode of execution of any work, or as to any other thing connected with or relative to any work undertaken by the telegraph authroity under those powers.

Title : Penalty for Neglect or Failure to Comply with Requisition Under Section 10 or 12

Whoever neglects or fails to submit a bull for inspection when required by a live-stock officer for inspection under section 10 or whoever fails to produce a licence when required to do so in accordance with the provisions of section 12 shall, on conviction, be punishable with fine which may extend to Rs. 25.

Title : Review of Orders Under Section 10 or 21

(1) When any person is aggrieved by an order made under section 10 or under section 21, such person, on payment of the prescribed fees, may within thirty days of the said order, apply to the State Government for review of the same, and the State Government shall then take the advice of the Advisory Board in the prescribed manner and shall consider such advice and pass such orders in the matter as the State Government may think to be just and proper. (2) With a view to enabling the Board to tender their advice under sub-section (1) the Board, with the consent of the State Government and on payment of such further fees as may be prescribed, may make such further inquiry into the matter as the Board may consider to be necessary.

Title : Taking Measurements and Photographs, Etc., of Persons Against Whom Order Under Section 10 is Made

State : Central

Year : 1989

(1) Every person against whom an order has been made under section 10 shall, if so required by the Special Court, allow his measurements and photographs to be taken by a police officer. (2) If any person referred to in sub-section (1), when required to allow his measurements or photographs to be taken, resists or refuses to allow the taking of such measurements or photographs, it shall be lawful to use all necessary means to secure the taking thereof. (3) Resistance to or refusal to allow the taking of measurements or photographs under sub-section (2) shall be deemed to be an offence under section 186 of the Indian Penal Code (45 of 1860). (4) Where an order under section 10 is revoked, all measurements and photographs (including negatives) taken under sub-section (2) shall be destroyed or made over to the person against whom such order is made.

Indian Telegraph Act, 1885 (13 of 1885) Section 16

Title : Exercise of Powers Conferred by Section 10, and Disputes as to Compensation, in Case of Property Other Than That of a Local Authority

.....District Magistrate may, in his discretion, order that the telegraph authority shall be permitted to exercise them. (2) If, after the making of an order under sub-section (1), any person resists the exercise of those powers, or, having control over the property, does not give all facilities for their being exercised, he shall be deemed to have committed an offence under section 188 of the Indian Penal Code, 1860 (45 of 1860). (3) If any dispute arises concerning the sufficiency of the compensation to be paid under section 10, clause (d), it shall, on application for that purpose by either of the disputing parties to the District Judge within whose jurisdiction the property is situate, be determined by him. (4) If any dispute arises as to the persons entitled to receive compensation, or as to the proportions in which the persons interested are entitled to share in it, the telegraph authority may pay into the Court of the District Judge such amount as he deems sufficient or, where all the disputing parties have in writing admitted the amount tendered to be sufficient or the amount has been determined under subsection (3), that amount; and the District Judge, after giving.....
