Sd/- New Delhi (SHEILA DIKSHIT) Dated: Chief Minister FINIANCIAL MEMORANDUM Under sub-section (1) of Section 17 of the Code of Criminal Procedure, 1973 the High Court shall, in relation to every Metropolitan Area within its local jurisdiction appoint a Metropolitan Magistrate to be the Chief Metropolitan Magistrate for such Metropolitan Area. Sub-section (2) of Section 17 of the said Code further provides that the High Court may appoint any Metropolitan Magistrate to be an Additional Chief Metropolitan Magistrate and such Magistrate shall have all or any of the powers of the Chief Metropolitan Magistrate under that Code or under any other law for the time being force as the High Court may direct. At present, Delhi, being a single Metropolitan Area, is having one Chief Metropolitan Magistrate and four Additional Chief Metropolitan Magistrates have been appointed by the High Court in terms of sub-section (2) of Section 17 of the said Code. It is proposed to divide Delhi into nine Metropolitan Areas corresponding to the nine proposed Sessions Division. Each Sessions Division will be headed by a District and Sessions.....

"Production Capacity" means: The annual quantitative potential for manufacturing a specific chemical based on the technological process actually used or, if the process is not yet operational, planned to be used at the relevant facility. It shall be deemed to be equal to the nameplate capacity or, if the nameplate capacity is not available, to the design capacity. The nameplate capacity is the product output under conditions optimized for maximum quantity for the production facility, as demonstrated by one or more test-runs. The design capacity is the corresponding theoretically calculated product output. 11. "Organization" means: The Organization for the Prohibition of Chemical Weapons established pursuant to Article VIII of this Convention. 12. For the purposes of Article VI: (a) "Production" of a chemical means its formation through chemical reaction; (b) "Processing" of a chemical means a physical process, such as formulation, extraction and purification, in which a chemical is not converted into another chemical; (c) "Consumption" of a chemical means its conversion into another chemical.....

.....309, the Government of India is now compelled to deal with many of these matters by means of non-statutory executive orders. This is neither satisfactory nor quite justifiable. 2. Before the commencement of the Constitution, the Government of India issued the Indian Civil Administrative Cadre Rules and the Indian Police Service Cadre Rules. Although these Rules, in so far as they are not inconsistent with the Constitution, are continued in force by Article 313of the Constitution, they authorise the regulation of only such items relating to the conditions of service as had already been settled. Emergency recruitment to these services to fill the gaps left by the departure of the British element in the I.C.S. and the Indian Police was still in progress at that time. Many matters relating to the conditions of service of such officers were only decided after the Constitution had come into force. Other very important matters such as the fixation of retirement benefits have yet to be settled. Arrangements have also been completed recently to extend the Indian Administrative Service and the Indian Police Service schemes to the Part B States. 3. It is necessary that Parliament should.....
