Title: Act Done in Good Faith for Benefit of a Person Without Consent

.....an operation be immediately performed. There is no time to apply to the child's guardian. A performs the operation in spite of the entreaties of the child, intending, in good faith, the child's benefit. A has committed no offence. (d) A is in a house which is on fire, with Z, a child. People below hold out a blanket. A drops the child from the house-top, knowing it to be likely that the fall may kill the child, but not intending to kill the child, and intending, in good faith, the child's benefit. Here, even if the child is killed by the fall, A has committed no offence. Explanation.--Mere pecuniary benefit is not benefit within the meaning of sections 88, 89 and 92.

1 [92. Subrogation Any of the persons referred to insection 91 (other than the mortgagor) and any co-mortgagor shall, on redeemingproperty subject to the mortgage, have, so far as regards redemption,foreclosure or sale of such property, the same rights as the mortgagee whosemortgage he redeems may have against the mortgagor or any other mortgagee. The right conferred by this sectionis called the right of subrogation, and a person acquiring the same is said tobe subrogated to the rights of the mortgagee whose mortgage he redeems. A person who has advanced to amortgagor money with which the mortgage has been redeemed shall be subrogated tothe rights of the mortgagee whose mortgage has been redeemed, if the mortgagorhas by a registered instrument agreed that such persons shall be so subrogated. Nothing in this section shall bedeemed to confer a right of subrogation on any person unless the mortgage inrespect of which the right is claimed has been redeemed in full. ________________________ 1. Title: Choice Between Criminal Court and Force Court

When a criminal court and a Force Court have each jurisdiction in respect of an offence, it shall be in the discretion of the Director-General, Additional Director-General or the Inspector-General or the Deputy Inspector-General or the Additional Deputy Inspector-General within whose command the accused person is serving or such other officer as may be prescribed, to decide before which court the proceedings shall be instituted, and if that officer decides that they shall be instituted before a Force Court, then he may direct that the accused person shall be detained in Force custody.

Title: Lease of Octroi, Terminal Tax or Toll

It shall be lawful for the Chief Executive Officer, with the previous sanction of the Board to lease the collection of any octroi, terminal tax or toll for any period not exceeding one year; and the lessee and all persons employed by him in the management and collection of the octroi, terminal tax or toll shall, in respect thereof,-- (a) be bound by any orders made by the Chief Executive Officer for their guidance; (b) have such powers exercisable by officers or employees of the Board under this Act as the Board may confer upon them; and (c) be entitled to the same remedies and be subject to the same responsibilities as if they were employed by the Board for the management and collection of the octroi, terminal tax or toll, as the case may be: Provided that no article distrained may be sold except under the orders of the Chief Executive Officer.

Title: Implied Gift to Objects of Power in Default of Appointment

Where property is bequeathed to or for the benefit of certain objects as a specified person may appoint or for the benefit of certain objects in such proportions as a specified person may appoint, and the Will does not provide for the event of no appointment being made; if the power given by the Will is not exercised, the property belongs to all the objects of the power in equal shares. Illustration A, by his Will bequeaths a fund to his wife, for her life, and directs that at her death it shall be divided among his children in such proportions as she shall appoint. The widow dies without having made any appointment. The fund Will be divided equally among the children.

Title: Definitions

In this Scheme, unless the context otherwise requires,-- (a) "Chapter" means Chapter V of the Finance Act, 1994(32 of 1994); (b) "designated authority" means an officer not below the rank of Assistant Commissioner of Central Excise as notified by the Commissioner of Central Excise for the purposes of this Scheme; (c) "person" means any person against whom any tax arrear is pending; (d) "prescribed" means prescribed by rules made under this Scheme; (e) "tax arrear" means service tax, cess, interest or penalty due or payable or leviable under the Chapter but not paid as on the 1st day of March, 2008, in respect of which,-- (i) an order has been passed under the Chapter; or (ii) a demand notice or a show cause notice has been issued on or before the 1st day of March, 2008 under the Chapter; (f) all other words and expressions used herein and not defined but defined in the Chapter or the rules made thereunder, shall have the meanings respectively assigned to them in the Chapter or the rules made thereunder.
