Title: Power of Court as to Evidence and Regulation of Proceedings

1 [(1)] For the purpose of any investigation or inquiry under this Part, the court making the investigation or inquiry shall in respect of compelling the attendance and examination of witnesses and the production of documents and the regulation of the proceedings, have the same powers as are exercisable by that court in the exercise of its criminal jurisdiction. 1 [(2) Subject to any rules made in this behalf by the Central Government, the court making an investigation or inquiry under this Part may, if it thinks fit, order the payment, on the part of that Government, of the reasonable expenses of any witness attending for the purposes of such investigation or inquiry before such court.] _______________________ 1. Title: Substitution of New Section of Section 10

For section 10 of the principal Act, the following section shall be substituted, namely:- "10 Penalty for being member of an unlawful association, etc. Where an association is declared unlawful by a notification issued under section 3 which has become effective under sub-section (3) of that section,- (a) a person, who- (i) is and continues to be a member of such association; or (ii) takes part in meetings of such association; or (iii) contributes to, or receives or solicits any contribution for the purpose of, such association; or (iv) in any way assists the operations of such association, shall be punishable with imprisonment for a term which may extend to two years, and shall also be liable to fine; and (b) a person, who is or continues to be a member of such association, or voluntarily does an act aiding or promoting in any manner the objects of such association and in either case is in possession of any unlicensed firearms, ammunition, explosive or other instrument or substance capable of causing mass destruction and commits any act resulting in loss of human life or grievous injury to any person or causes significant damage to any property,- (i) and if.....

.....hundred and fifty rupees by the Chairman and in every other case by the Board : Provided that in the case of officers of the Government lent to the Board, the Chairman may exercise the powers of granting leave and sanctioning increments and after following the prescribed procedure, of withholding increments and shall report the fact to the Head of the Department to which such officer belongs. Explanation.- For purposes of section 365 of the Karnataka Municipalities Act, 1964, the Board shall be deemed to be a local authority. (2) The power of dispensing with the services of any officer or servant of the Board, otherwise than by reason of such officers or servants misconduct or of permitting any such officer or servant to retire on a pension, gratuity or compassionate allowance shall, subject to the aforesaid provisions, be exercised only by the Board. (3) Any party aggrieved by an order of the Board under sub-section (2) may appeal to the Government within thirty days of the order.

Title: Licence for Slaughter-houses

(1) The owner of any place within the limits of the city or at a distance within five kilometers of such limits which is used as a slaughter house for the slaughtering of animals or for the skinning or cutting up of carcasses shall, not less than thirty days before the commencement of the year for which the licence is sought or in the case of a place to be newly opened, not less than one month before the opening of the same, apply to the Commissioner for a licence: Provided that this sub-section shall not be applicable to any area outside the limits of the city except with the previous sanction of the Government. (2) The Commissioner may by an order, and subject to such restrictions and regulations as to supervision and inspection, as he thinks fit, grant or refuse to grant such licence.

Title: Order of Dissolution of Company

(1) The Official Liquidator shall, if he is satisfied that the company is finally wound up, submit a final report to-- (i) the Central Government, in case no reference was made to the Tribunal under sub-section (4) of section 364; and (ii) in any other case, the Central Government and the Tribunal. (2) The Central Government, or as the case may be, the Tribunal on receipt of such report shall order that the company be dissolved. (3) Where an order is made under sub-section (2), the Registrar shall strike off the name of the company from the register of companies and publish a notification to this effect.

.....which has for its object any activity which is punishable under section 153A(45 of 1860) or section 153B of the Indian Penal Code, or which encourages or aids persons to undertake any such activity, or of which the members undertake any such activity: Provided that nothing contained in sub-clause (ii) shall apply to the State of Jammu and Kashmir; (q) words and expressions used but not defined in this Act and defined in the Code shall have the meanings respectively assigned to them in the Code. (2) Any reference in this Act to any enactment or any provision thereof shall, in relation to an area in which such enactment or such provision is not in force, be construed as a reference to the corresponding law or the relevant provision of the corresponding law, if any, in force in that area.'.
