Title: Appeal Against Orders Passed Under Section 12b

1[(1) Every order passed under section 12B, including any order determining compensation for requisitioning vehicles shall be appealable to the Collector if it is passed by any officer lower in rank than that of a Collector and to the prescribed authority it is passed by the Collector. (2) Such appeal shall be presented within 30 days of the date on which the order appealed against was served on the appellant. (3) Every order passed in such appeal shall be final.] ______________ 1. JURISDICTION ,POWERS AND PROCEDURE OF THE CORPORATION 1[12C. Enforcement of the order made by the Commission under section 12A or 12B. - Every order made by the Commission under section 12A granting a temporary injunction or under section 12B directing the owner of an undertaking or other person to make payment of any amount, may be enforced by the Commission in the same manner as if it were a decree or order made by a court in a suit pending therein and it shall be lawful for the Commission to send, in the event of its inability to execute it, such order to the court within the local limits, of whose jurisdiction,- (a) in the case of an order against a company, the registered office of the company is situated, or (b) in the case of an order against any other person, the place where the person concerned voluntarily resides or carries on business or personally works for gain, is situated, and thereupon the court to which the order is so sent shall execute the order as if it were a decree or order sent to it for execution.] ________________________ 1. National Commission for Minority Educational Institutions Act, 2004 Section 12B

Title: Power of Commission to Decide on the Minority Status of an Educational Institution

After section 12A of the principal Act, the following section shall be inserted, namely:-- 12B. Regulation of acquisition of shares or voting rights.-- (1) No person (hereinafter referred to as "the applicant") shall, except with the previous approval of the Reserve Bank, on an application being made, acquire or agree to acquire, directly or indirectly, by himself or acting in concert with any other person, shares of a banking company or voting rights therein, which acquisition taken together with shares and voting rights, if any, held by him or his relative or associate enterprise or person acting in concert with him, makes the applicant to hold five per cent. or more of the paid-up share capital of such banking company or entitles him to exercise five per cent. or more of the voting rights in such banking company. Explanation 1.--For the purposes of this sub-section,-- (a) "associate enterprise" means a company, whether incorporated or not, which,-- (i) is a holding company or a subsidiary company of the applicant; or (ii) is a joint venture of the applicant; or (iii) controls the composition of the Board of Directors or other body governing the applicant; or .....
