THE MIZORAM MUNICIPALITIES ACT, 2007 THE MIZORAM MUNICIPALITIES ACT, 2007 (Act No.6 of 2007) [Received the assent of the Governor of Mizoram on 16th April/2007] An Act to provide for the administration of town areas and to establish municipalities in towns, transitional areas and urban areas in Mizoram. Whereas it is expedient and necessary to provide for the administration of town areas viz., transitional areas and urban areas and to introduce municipalities in Mizoram for the purpose of bringing them in conformity with the purpose, substance and direction of the Constitution (Seventy-fourth) Amendment Act, 1992 in general, and in particular to endow the municipalities with functions and powers so as to enable them to function as vibrant Institution of Local Self Government with greater People's participation in managing their own affairs besides importing certainty, continuity and democratic content and dignity, aiming among other things at the realisation of economic and social justice; It is enacted by the Legislative Assembly of Mizoram in the Fifty-eighth Year of the Republic of India as follows: CHAPTER -I PRELIMINARY 1. .....in any other law for the time being in force, the Institute shall have power to grant degrees and other academic distinctions and titles under this Act. .....the commencement of this Act shall be constructed as a reference to the coming into force of that Act in such areas. SECTION 2 : Extension and amendment of the National Rural Employment Guarantee Act, 2005 (1) The National Rural Employment Guarantee Act, 2005 (42 of 2005) (hereinafter referred to as the principal Act) and all rules, orders and schemes made thereunder by the Central Government are hereby extended to, and shall be in force in, the State of Jammu and Kashmir. (2) With effect from the date of commencement of this Act, in the principal Act, in sub-sec. (2) of (Section 1) , the words "except the State of Jammu and Kashmir" shall be omitted. SECTION 3 : Construction of reference to a law not in force in Jammu and Kashmir Any reference in any Act mentioned in the principal Act to a law which is not in force, in the State of Jammu and Kashmir shall, in relation to that State, be constructed as a reference to the corresponding law; if any, in force in that State. .....if a final order has been made by the Central Government or other authority or officer or other person competent to pass such order under the said Acts, rules and regulations, rejecting any petition preferred or representation made by such person; (b) where no final order has been made by the Central Government or other authority or officer or other person competent to pass such order with regard to the petition preferred or representation made by such person, if a period of six months from the date on which such petition was preferred or representation was made has expired. Section 22 - Limitation The Tribunal shall not admit an application-- (a) in a case where a final order such as is mentioned in clause (a) of sub-section (2) of section 21 has been made unless the application is made within six months from the date on which such final order has been made; (b) in a case where a petition or a representation such as is mentioned in clause (b) of sub-section (2) of section 21 has been made and the period of six months has expired thereafter without such final order having been made; (c) in a case where the grievance in respect of which an application is made had.....
