Karnataka Prohibition Act, 1961 Section 36

Title: Authorisation for Sacramental Purposes

.....to its control, the Deputy Commissioner, may grant any authorisation to any person for the use of liquor for sacramental purposes or for the manufacture of liquor for use for sacramental purposes: Provided that the State Government or the Deputy Commissioner is satisfied that the use of such liquor is required in accordance with the religious tenets of the community to which such person belongs. (2) An authorisation under this section shall be granted on the recommendation of the person, who consistently with the religious tenets of the community to which the person applying for such authorisation belongs, exercises control over sacramental matters relating to such community and has been approved by the State Government in that behalf. (3) If in any community there is no person who exercises control over sacramental matters relating to such community, and if, in the opinion of the State Government, it is so desirable, the authorisation under this section may be granted on the recommendation of such member of the community, as may be approved by the State Government in this behalf. .....of the licence, pass, permit or authorisation is convicted of any cognizable and non-bailable offence or of any offence under the Dangerous Drugs Act, 1930 (Central Act II of 1930) , or under the Trade and Merchandise Marks Act, 1958 (Central Act 43 of 1958) , or any offence punishable under sections 482 to 489 (both inclusive) of the Indian Penal Code, or any offence punishable under Article 8 of the Schedule to section 167 of the Sea Customs Act, 1878 (Central Act VIII of 1878) . (2) Where a licence, permit, pass or authorisation held by any person is cancelled under sub-section (1) , the authority aforesaid may cancel any other licence, permit, pass or authorisation granted or deemed to have been granted to such person under this Act. .....in the Schedule shall cease to be in force in such area to the extent specified in the fourth column of the Schedule. (2) The Orissa Prohibition Act, 1939 (Orissa Act VII of 1939) is hereby repealed.
