.....in the Forty-sixth Year of the Republic of India as follows :- CHAPTER 1 : PRELIMINARY SECTION 1 : Short title, extent and commencement (1) This Act may be called the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995. (2) It extends to the whole of India except the State of Jammu and Kashmir. (3) It shall come into force on such date3 (a) [a] 7-2-1996-See Gax. of Ind.. 7-9-1996. Pt. II, S. 3(i), Ext., p. 1 (No. 84). as the Central Government may, by notification, appoint. SECTION 2 : Definitions In this Act, unless the context otherwise requires.- (a) "appropriate Government" means,- (i) in relation to the Central Government or any establishment wholly or substantially financed by that Government, or a Cantonment Board constituted under the Cantonment Act, 1924 the Central Government: (ii) in relation to a State Government or any establishment wholly or substantially financed by that Government, or any local authority, other than a Cantonment Board, the State Government: (iii) in respect of the Central Co-ordination Committee and the Central Executive Committee, the Central Government: (iv) in respect of the State.....

.....Act, 1959. Be it enacted by the Legislature of the State of Orissa in the Forty-sixth Year of the Republic of India as follows:" 1. Short title and commencement. (1) This Act may be called the Orissa Legislative Assembly Deputy speaker's Salary and Allowances (Amendment) Act, 1995. (2) It shall come into force on the 1st day of August, 1995. . 2. Amendment of section 3. In the Orissa Legislative Assembly Deputy Speaker's Salary and Allowances Act, 1959, In section 3, for the words "two .thousand rupees", the words "three thousand and five bundled rupees" shall be substituted and after section 3, the following new section shall be inserted, namely;" "3-A. Sitting Allowance. There shall be paid to the Deputy Speaker-a daily sitting allowance for attending Assembly Session or Committee thereof, of one hundred and fifty Allowance rupees. The appropriate Governments and the local authorities shall, within the limits of their economic capacity and development, provide for-- (a) installation of auditory signals at red lights in the public roads for the benefit of persons with visually handicap; (b) causing curb cuts and slopes to be made in pavements for the easy access of wheel chair users; (c) engraving on the surface of the zebra crossing for the blind or for persons with low vision; (d) engraving on the edge of railway platforms for the blind or for persons with low vision; (e) devising appropriate symbols of disability; (f) warning signals at appropriate places.

Finance Act, 1995 Section 45

Title: Amendment of Section 253

In section 253 of the Income-tax Act, with effect from the 1st day of July, 1995, - (i) in sub-section (1), after clause (a), the following clause shall be inserted, namely :- "(b) an order passed by an Assessing Officer under clause (c) of section 158BC; or"; (ii) in sub-section (3), the following proviso shall be inserted at the end, namely :- 'Provided that in respect of any appeal under clause (b) of sub-section (1), this sub-section shall have effect as if for the words "sixty days", the words "thirty days" had been substituted.'

Delhi Rent Act, 1995 Section 45

Title: Procedure to Be Followed by Rent Authority

.....aforesaid. (c) The Rent Authority shall give to the tenant leave to contest the application if the affidavit filed by the tenant discloses such facts as would disentitle the landlord from obtaining an order for the recovery of possession of the premises. (d) Where leave is granted to the tenant to contest the application, the Rent Authority shall ordinarily commence the hearing of the application within seven days of the grant of such leave and shall provide day to day hearing and shall dispose of the application within thirty days of starting of such hearing, failing such commencement of hearing or disposal of application within such time, the Rent Authority shall inform the Chairman of the Tribunal the reasons therefore. (e) Where the leave to contest under clause (c) is denied to the tenant, he may file an application for review before the Rent Authority within ten days of such denial and the Rent Authority shall endeavourer to dispose of such application within seven days of its filing. (9) Every application made to the Rent Authority shall be heard as expeditiously as possible and, subject to the provisions of sub-sections (7) and (8), endeavourer shall be made to.....

Wakf Act, 1995 Section 45

Title: Preparation of Budget of Wakfs Under Direct Management of the Board

.....of the wakf shall be construed as pre-references to the Chief Executive Officer. (5) The audit of accounts of every wakf under the direct management of the Board shall be undertaken by the State Examiner of Local Funds or any other officer appointed by the State Government for this purpose, irrespective of the income of the wakf. (6) The provisions of sub-sections (2) and (3)of section 47 and the provisions of sections 48 and 49 shall in so far as they are not inconsistent with the provisions of this section, apply to the audit of accounts referred to in this section. (7) Where any wakf is under the direct management of the Board, such administrative charges as may be specified by the Chief Executive Officer shall be payable by the wakf of the Board: Provided that the Chief Executive Officer shall not collect more than ten per cent. of the gross annual income of the wakf under the direct management of the Board as administrative charges.

In section 45 of the Customs Act, after sub-section (2), the following sub-section shall be inserted,"(3) Notwithstanding anything contained in any law for the time being in force, if any imported goods are pilfered after unloading thereof in a customs area while in the custody of a person referred to in sub-section (1), that person shall be liable to pay duty on such goods at the rate prevailing on the date of delivery of an import manifest or, as the case may be, an import report to the proper officer under section 30 for the arrival of the conveyance in which the said goods were carried.

WAKF ACT, 1995 Section 48

Title: Board to pass orders on auditor's report

(3) No application made under sub-section (2) shall be entertained by the Tribunal unless the amount certified by the auditor under sub-section (2) of section 47 has first been deposited in the Tribunal and the Tribunal shall not have any power to stay the operation of the order made by the Board under sub-section (1). (4) The order made by the Tribunal under sub-section (2) shall be final. (5) Every amount for the recovery of which any order has been made under sub-section (1) or sub-section (2) shall, where such amount remains unpaid, be recoverable in the manner specified in section 34 or section 35 as if the said order were an order for the recovery of any amount determined under sub-section (3) of section 35.
