.....the Central Government or the person, officer or authority in respect of anything done by it or him in good faith in pursuance of this Act or of any rule or order made, or direction issued, thereunder. 48. Power to make rules. - (1) The Central Government may, by notification, make rules for carrying out the purposes of this Act. 38.1[Deputy Commissioner]'s power to refund penalty paid under sub-section (1) of Section 37 (1) When a copy of an instrument is sent to the1[Deputy Commissioner] under sub-section (1) of Section 37, he may, if he thinks fit, refund any portion of the penalty in excess of five rupees which has been paid in respect of such instrument. (2) When such instrument has been impounded only because it has been written in contravention of Section 13 or Section 14, the1[Deputy Commissioner] may refund the whole penalty so paid. ________________________ 1. I, to Pondicherry by Reg. 7 of 1963, sec. 3 and Sch. I, and to Laccadive, Minicoy and Amindivi Islands by Reg. 8 of 1965, sec. 3 and Sch., and has also been declared in force in the district of Khondmals by sec. 3 and Sch. of the Khondmals Laws Regulation, 1936 (4 of 1936) and in the district of Angul by sec. 3 and Sch. of the Angul Laws Regulation, 1936 (5 of 1936). Extended to Sikkim w.e.f. 1-11-1986 vide G.S.R. 529 (E), dt. 30-12-1986.
