THE SIKKIM PRISONS ACT, 2007 THE SIKKIM PRISONS ACT, 2007 (Act No. 16 of 2007) AN ACT To provide for a law regulating the prisons in Sikkim. Be it enacted by the Legislature of Sikkim in the Fifty-eighth Year of the Republic of India as follows: - CHAPTER I Short title, extent and commencement. 1. (1) This Act may be called the Sikkim Prisons Act, 2007 (2) It extends to the whole of Sikkim; (3) It shall come into force on such date as the State Government may, by notification, in the official gazette appoint. Definitions. In this Act, unless the context otherwise requires: - (a) "civil prisoner" means any prisoner who is not a criminal prisoner; 2 . (b) "Competent authority" means any officer having jurisdiction and legal authority to deal with a particular matter in question; (c) "convicted criminal prisoner" means any criminal prisoner under sentence of court or court-martial, and includes a person detained in prison under the provision of Code of Criminal Procedure, 1973; (d) "Court" includes any officer lawfully exercising civil, criminal or revenue jurisdiction; (e) "criminal prisoner" means any prisoner duly committed to custody.....

.....on the 1st day of April, 2007 and ending before the 1st day of April, 2017, begun or begins, in any of the North-Eastern States,-- (i) to manufacture or produce any eligible article or thing; (ii) to undertake substantial expansion to manufacture or produce any eligible article or thing; (iii) to carry on any eligible business. (3) This section applies to any undertaking which fulfils all the following conditions, namely:-- (i) it is not formed by splitting up, or the reconstruction, of a business already in existence: Provided that this condition shall not apply in respect of an undertaking which is formed as a result of the re-establishment, reconstruction or revival by the assessee of the business of any such undertaking as referred to in section 33B, in the circumstances and within the period specified in the said section; (ii) it is not formed by the transfer to a new business of machinery or plant previously used for any purpose. Explanation.--The provisions of Explanations 1 and 2 to sub-section (3) of section 80-IA shall apply for the purposes of clause (ii) of this sub-section as they apply for the purposes of clause (ii) of that sub-section. THE KERALA WOMEN'S COMMISSION (AMENDMENT) ACT, 2007 ACT 27 OF 2007 THE KERALA WOMEN'S COMMISSION (AMENDMENT) ACT, 2007 An Act further to amend the Kerala Women's Commission Act, 1991. Preamble.- WHEREAS, it is expedient further to amend the Kerala Women's Commission Act, 1991 (17 of 1995) for the purposes hereinafter appearing; BE it enacted in the Fifty-eighth Year of the Republic of India as follows:- 1. Short title and commencement.- (1) This Act may be called the Kerala Women's Commission (Amendment) Act, 2007. (2) It shall be deemed to have come into force on the 24th day of January, 2007. 2. Amendment of section 2.- In section 2 of the Kerala Women's Commission Act, 1991 (17 of 1995) (hereinafter referred to as the principal Act), after clause (h), the following clause shall be inserted, namely:- "(ha) "Secretary" means the Member Secretary of the Commission appointed under sub-section (1) of section 12;". 3. (1) It shall be the general duty of the Council to co-ordinate the activities of all the Institutes. (2) Without prejudice to the provisions of sub-section (1), the Council shall perform the following functions, namely:-- (a) to advise on matters relating to the duration of the courses, the degrees and other academic distinctions to be conferred by the Institutes, admission standards and other academic matters; (b) to lay down policy regarding cadres, methods of recruitment and conditions of service of employees, institution of scholarships and freeships, levying of fees and other matters of common interest; (c) to examine the development plans of each Institute and to approve such of them as are considered necessary and also to indicate broadly the financial implications of such approved plans; (d) to advise the Visitor, if so required, in respect of any function to be performed by him under this Act; and (e) to perform such other functions as are assigned to it by or under this Act.
