.....anything necessary for the proper discharge of his duties; and (c) exercise such other powers as may be prescribed, SECTION 09: ANNUAL REPORT OF ACTIVITIES FINANCED UNDER THIS ACT The Central Government shall, as soon as may be, after the end of each financial year, cause to be published in the Official Gazette, a report giving an account of the activities financed under this Act during the financial year, together with a statement of accounts. SECTION 10: POWER TO CALL FOR INFORMATION The Central Government may require a producer to furnish, for the purposes of this Act, such satisfied and other information in such form and within such period as may be prescribed. SECTION 11: POWER TO MAKE RULES 6 (1) The Central Government may, by notification in the Official Gazette, make rules for carrying out the provisions of this Act. 1[32. Issue of guarantees. -- The National Bank may guarantee, subject to such directions as may be issued by the Board, from time to time, deferred payments in connection with the purchase of capital goods or for any other purpose for giving effect to the provisions of this Act, due from any person or class of persons, whether incorporated or not.] ________________________ 1. Issue of guarantees. -- The National Bank may guarantee, with the prior approval of the Central Government and on such terms and conditions as may be agreed upon deferred payments in connection with the purchase of capital goods (i) due from a co-operative society approved by the Reserve Bank in this behalf or such other institution which may, on the recommendation of the Reserve Bank, be approved by the Central Government in this behalf, or (ii) due from any other person and guaranteed to the National Bank by a State land development bank or a State co-operative bank or a scheduled bank."

Title: Arrangement with Exim Bank on Appointment of Directors to Prevail

.....made in pursuance thereof shall be valid and effective notwithstanding anything to the contrary contained in the Companies Act, 1956, or in any other law for the time being in force or in the memorandum, articles of association or any other instrument relating to the company and any provision regarding share qualification, age limit, number of directorships, removal from office of directors and such like conditions contained in any such law or instrument aforesaid, shall not apply to any director appointed by the Exim Bank in pursuance of the arrangement as aforesaid. (2) Any director appointed as aforesaid shall- (a) hold office during the pleasure of the Exim Bank and may be removed or substituted by any person by order in writing of the Exim Bank; (b) not incur any obligation or liability by reason only of his being a director or for anything done or omitted to be done in good faith in the discharge of his duties as a director or anything in relation thereto; (c) not be liable to retirement by rotation and shall not be taken into account for computing the number of directors liable to such retirement.

The Central Government may, after due appropriation made by Parliament by law in this behalf, make in each financial year such contributions to the State Boards as it may think necessary to enable the State Boards to perform their functions under this Act: Provided that nothing in this section shall apply to any1[State Pollution Control Board] constituted under section 4 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974), which is empowered by that Act to expend money from its fund thereunder also for performing its functions, under any law for the time being in force relating to the prevention, control or abatement of air pollution. ________________________ 1.
