THE KERALA WOMEN'S COMMISSION (AMENDMENT) ACT, 2007 ACT 27 OF 2007 THE KERALA WOMEN'S COMMISSION (AMENDMENT) ACT, 2007 An Act further to amend the Kerala Women's Commission Act, 1991. Preamble.- WHEREAS, it is expedient further to amend the Kerala Women's Commission Act, 1991 (17 of 1995) for the purposes hereinafter appearing; BE it enacted in the Fifty-eighth Year of the Republic of India as follows:- 1. Short title and commencement.- (1) This Act may be called the Kerala Women's Commission (Amendment) Act, 2007. (2) It shall be deemed to have come into force on the 24th day of January, 2007. 2. Amendment of section 2.- In section 2 of the Kerala Women's Commission Act, 1991 (17 of 1995) (hereinafter referred to as the principal Act), after clause (h), the following clause shall be inserted, namely:- "(ha) "Secretary" means the Member Secretary of the Commission appointed under sub-section (1) of section 12;". 3. Amendment of section 5.- (1) For sub-sections (1) and (2) of section 5 of the principal Act, the following sub-sections shall be substituted, namely:- "(1) For the purposes of this Act the Government shall, by notification in the Gazette, constitute a.....

Title: Insubordination and Obstruction

.....force to, or assaults any person, whether subject to this Act or not, in whose custody he is lawfully placed, and whether he is or is not his superior officer; or (c) resists an escort whose duty it is to apprehend him or to have him in charge; or (d) breaks out of barracks, camp or quarters; or (e) neglects to obey any general, local or other order; or (f) impedes the Force Police referred to in section 75 or any person lawfully acting on his behalf, or when called upon, refuses to assist in the execution of his duty a Force Police or any person lawfully acting on his behalf, shall, on conviction by a Force Court, be liable to suffer imprisonment for a term which may extend, in the case of the offences specified in clauses (d) or (e), to two years, and in the case of the offences specified in the other clauses, to ten years, or in either case such less punishment as is in this Act mentioned.

.....control of the Board who shall be the Chairperson ex officio; (b) a senior technical officer conversant with the inspection and examination of boilers, to be nominated by the Government of each State (other than a Union territory); (c) equal number of other persons as in sub-section (b) above to represent-- (i) Central Government, (ii) the Bureau of Indian Standards, (iii) boiler and boiler component manufacturers, (iv) National laboratories, (v) engineering consultancy agencies, (vi) users of boilers, and (vii) such other interests which in the opinion of the Central Government ought to be represented on the Board, to be nominated by the Central Government; (d) Technical Adviser, Member-Secretary ex officio. (3) The term of office of the members nominated under clauses (b) and (c) of sub-section (2) shall be such as may be prescribed by the Central Government.".

(1) The Institute shall maintain a fund to which shall be credited-- (a) all moneys provided by the Central Government; (b) all fees and other charges; (c) all moneys received by the Institute by way of grants, gifts, donations, benefactions, bequests or transfers; and (d) all moneys received by the Institute in any other manner or from any other source. (2) All moneys credited to the fund shall be deposited in such banks or invested in such manner as may be decided by the Board. (3) The fund shall be applied towards meeting the expenses of the Institute including expenses incurred in the exercise of its powers and discharge of its duties under this Act.

.....system providers or where any of the system participants is not satisfied with the decision of the panel referred to in sub-section (1), the dispute shall be referred to the Reserve Bank. (4) The dispute referred to the Reserve Bank for adjudication under sub-section (3) shall be disposed of by an officer of the Reserve Bank generally or specially authorised in this behalf and the decision of the Reserve Bank shall be final and binding. (5) Where a dispute arises between the Reserve Bank, while acting in its capactiy as system provider or as system participant, and another system provider or system participant, the matter shall be referred to the Central Government which may authorise an officer not below the rank of Joint Secretary for settlement of the dispute and the decision of such officer shall be final.

Title: Establishment and Incorporation of Authority

(1) With effect from such date as the Central Government may, by notification, specify in this behalf, there shall be constituted an authority to be called the Warehousing Development and Regulatory Authority to exercise the powers conferred on, and to perform the functions assigned to it by or under this Act. (2) The Authority shall be a body corporate by the name aforesaid having perpetual succession and a common seal with power, subject to the provisions of this Act, to acquire, hold and dispose of property, both movable and immovable, and to contract and shall, by the said name, sue or be sued. (3) The head office of the Authority shall be at New Delhi and the Authority may, with the previous approval of the Central Government, establish offices at other places in India.
