(1) This Act may be called the Orissa Legislative Assembly Deputy speaker's Salary and Allowances (Amendment) Act, 1995. (2) It shall come into force on the 1st day of August, 1995. . 2. Amendment of section 3. In the Orissa Legislative Assembly Deputy Speaker's Salary and Allowances Act, 1959, In section 3, for the words "two .thousand rupees", the words "three thousand and five bundled rupees" shall be substituted and after section 3, the following new section shall be inserted, namely;" "3-A. Sitting Allowance. There shall be paid to the Deputy Speaker-a daily sitting allowance for attending Assembly Session or Committee thereof, of one hundred and fifty Allowance rupees. Title: Vacancies Not to Invalidate Proceedings

No act or proceeding of the Central Co-ordination Committee, the Central Executive Committee, a State Co-ordination Committee or a State Executive Committee shall be called in question on the ground merely on the existence of any vacancy in or any defect in the constitution of such Committees.

Title: Appeals

(1) Save as provided in sub-section (2) and notwithstanding anything contained in the Code of Civil Procedure, 1908 (5 of 1908) or in any other law, an appeal shall lie against any award or other order, not being an interlocutory order, of the Tribunal to the Supreme Court on one or more of the grounds specified in section 100 of that Code. (2) No appeal shall lie against an award or other order made by the Tribunal with the consent of the parties. (3) Every appeal under this section shall be preferred within a period of ninety days from the date of the award or other order appealed against: Provided that no appeal by the person who is required to pay any amount in terms of such award shall be entertained by the Supreme Court unless be has deposited with it the amount so awarded in the manner directed by the Supreme Court: Provided further that the Supreme Court may entertain the appeal after the expiry of the said period of ninety days, if it is satisfied that the appellant was prevented by sufficient cause from preferring the appeal in time.

After section 112 of the Income-tax Act, the following section shall be inserted with effect from the 1st day of July, 1995, namely :- "113. Tax in the case of block assessment of search cases. - The total undisclosed income of the block period, determined under section 158BC, shall be chargeable to tax at the rate of sixty per cent."

Title: Right to Recover Immediate Possession of Premises to Accrue to Members of the Armed Forces, Etc

.....son or daughter, as the case may be, are required for his own residence after his retirement, he, his spouse or his dependent sort or daughter, as the case may be, may, at any time, within a period of one year before the date of his retirement, apply to the Rent Authority for recovery of immediate possession of such premises. (3) Where the person, his spouse or his dependent son or daughter referred to in sub-section (1) or sub-section (2) has let out more than one premises, it shall be open to him, his spouse or his dependent son or daughter, as the case may be, to make an application under the sub-section in respect of only one of the premises chosen. Explanation.-- For the purposes of this section, "armed forces" means an armed force of the Union constituted under an Act of Parliament and includes a member of the police force constituted under section 3 of the Delhi Police Act, 1978(34 of 1978).

Title: Disbursement of Money by the Commissioner to Claimants

After admitting a claim under this Act, the amount due in respect of such claim shall be credited by the Commissioner to the relevant fund or be paid to the person or persons to whom such sums are due and on such credit or payment the liability of the owner in respect of such claim shall stand discharged.

Title: Officers and Other Employees of the Board

(1) The Board shall have the assistance of such number of officers and other employees as may be necessary for the efficient performance of its functions under this Act, details thereof shall be determined by the Board in consultation with the State Government. (2) The appointment of officers and other employees, their term of office and conditions of service shall be such as may be provided by regulations.

Title: Board to pass orders on auditor's report

(3) No application made under sub-section (2) shall be entertained by the Tribunal unless the amount certified by the auditor under sub-section (2) of section 47 has first been deposited in the Tribunal and the Tribunal shall not have any power to stay the operation of the order made by the Board under sub-section (1). (4) The order made by the Tribunal under sub-section (2) shall be final. (5) Every amount for the recovery of which any order has been made under sub-section (1) or sub-section (2) shall, where such amount remains unpaid, be recoverable in the manner specified in section 34 or section 35 as if the said order were an order for the recovery of any amount determined under sub-section (3) of section 35.
