.....ship until such time as the owner, master or consignee thereof has satisfied any claim in respect of the damage or has given security to the satisfaction of the High Court to pay all costs and damages that may be awarded in any legal proceedings that may be instituted in respect of the damage, and any officer to whom the orders directed shall detain the ship accordingly. (2) Whenever it appears that before an application can be made under this section, the ship in respect of which the application is to be made will have departed from India of the territorial waters of India, any proper officer may detain the ship for such time as to allow the application to be made and the result thereof to be communicated to the officer detaining the ship, and that officer shall not be liable for any costs or damages in respect of the detention unless the same is proved to have been made without reasonable grounds. (3) In any legal proceedings in relation to any such damage aforesaid, the person giving security shall be made a defendant and shall for the purpose of such proceeding be deemed to be the owner of the ship that has occasioned the damage. .....an from the injury amount equal to 2[fifty per cent.] of the monthly wages of the deceased 14[employee] multiplied by the relevant factor; or an amount of 9[one lakh and twenty thousand rupees], whichever is more; (b) where permanent total disablement results from the injury an amount equal to 4[sixty per cent.] of the monthly wages of the injured 14[employee] multiplied by the relevant factor; or an amount of 10[one lakh and forty thousand rupees], whichever is more; 11[Provided that the Central Government may, by notification in the Official Gazette, from time to time, enhance the amount of compensation mentioned in clauses (a) and (b).] Explanation I.--For the purposes of clause (a) and clause (b), "relevant factor", in relation to a 14[employee] means the factor specified in the second column of Schedule IV against the entry in the first column of that Schedule specifying the number of years which are the same as the completed years of the age of the 14[employee] on his last birthday immediately preceding the date on which the compensation fell.....

This Act has been extended to Berar by the Berar Laws Act, 1941 (4 of 1941), to Goa, Daman and Diu by Reg. 12 of 1962, sec. 3 and Sch.; to Dadra and Nagar Haveli by Reg. 6 of 1963, sec. 2 and Sch. I, to Pondicherry by Reg. 7 of 1963, sec. 3 and Sch. I, and to Laccadive, Minicoy and Amindivi Islands by Reg. 8 of 1965, sec. 3 and Sch., and has also been declared in force in the district of Khondmals by sec. 3 and Sch. of the Khondmals Laws Regulation, 1936 (4 of 1936) and in the district of Angul by sec. 3 and Sch. of the Angul Laws Regulation, 1936 (5 of 1936). Extended to Sikkim w.e.f. 1-11-1986 vide G.S.R. 529 (E), dt. 30-12-1986. This Act has been modified in its application to apprentices under the Apprentices Act, 1961 (52 of 1961) by sec. 16 and Sch. to that Act. 2. Substituted by the Workmen's Compensation (Amendment) Act, 2009 to be effective from 18.01.2010 vide Notification No. S.O. 101(E) dated 18.01.2010 previous text was:- : "WORKMEN'S" 3. 1[Application of proceeds of tolls, farms and penalties.] Rep. Bom. 1 of 1884. __________________ 1 Section 16 which is repealed, except in the City of Bombay, by the Bombay Local Boards Act, 1884 (Bom. 1 of 1884), s. 2, and Schedule, is as follows :-- Clause 1--In each district the proceeds from tolls and farms of public ferries, and from penalties levied under this act, shall from the ferry fund of such district, and shall be appropriated in the first instance to the maintenance of the public ferries of the district, and the improvement the roads leading to the said ferries, the surplus, if any being expended on local works in the district in such manner as Government may from time to time direct. Clause 2--The limits of each district for the purposes of this section shall be such as Government may from time to time determine. Clause 3-- When a public ferry is partly in one district and partly in another it shall be lawful for Government to assign to each district such proportion of the proceeds as they shall deem fit. The Bombay Local Boards Act, 1884, has now been repealed by Bom. 6 of 1923.

.....or makes default in complying with any provisions of this Act shall, if no other penalty is elsewhere provided by or under this Act for such contravention or non-compliance, be punishable with imprisonment which may extend to three months, or with fine which may extend to one thousand rupees, or with both. (4) No court shall take cognizance of any offence punishable under this Act or under the Scheme except on a report in writing of the facts constituting such offence made by the Seamen's Provident Fund Commissioner or by an Inspector appointed under sub-section (1) of section 15, with the previous sanction of such authority as may be specified in this behalf by the Government. __________________________________ 9. Substituted for the words " six months, or with fine which may extend to one thousand rupees" by The Seamen's Provident Fund (Amendment) Act, 1997.

The 1[State Government] may, by notification in the Official Gazette, direct that every person employing 2[employees], or that any specified class of such persons, shall send at such time and in such form and to such authority, as may be specified in the notification, a correct return specifying the number of injuries in respect of which compensation has been paid by the employer during the previous year and the amount of such compensation together with such other particulars as to the compensation as the 1[State Government] may direct. ________________________ 1. The words "G.G. in C." have successively been substituted by the A.O. 1937 and the A.O. 1950 to read as above. 2.
