Title: Payment Under Decree

.....any money payable under a decree of any kind is paid out of Court, 1 [or a decree of any kind is otherwise adjusted] in whole or in part to the satisfaction of the decree-holder, the decree-holder shall certify such payment of adjustment to the Court whose duty it is to execute the decree, and the Court shall record the same accordingly. (2) The judgment-debtor 2 [or any person who has become surety for the judgment-debtor] also may inform the Court of such payment or adjustment, and apply to the Court to issue a notice to the decree-holder to show cause, on a day to be fixed by the Court, why such payment or adjustment should not be recorded as certified ; and if, after service of such notice, the decree-holder fails to show cause why the payment or adjustment should not be recorded as certified, the Court shall record the same accordingly, 3 [(2A) No payment or adjustment shall be recorded at the instance of the judgment-debtor unless-- (a) the payment is made in the manner provided in rule 1; or (b) the payment or adjustment is proved by documentary evidence; or (c) the payment or adjustment is admitted by, or on behalf of, the decree-holder in his reply to the.....

(2) Every case stated under this rule shall be divided into consecutively numbered paragraphs, and shall concisely state such facts and specify such documents as may be necessary to enable the Court to decide the question raised thereby. 2. Where value of subject-matter must be stated Where the agreement is for the delivery of any property, or for the doing, or the refraining from doing, any particular act, the estimated value of the property to be delivered, or to which the act specified has reference, shall be slated in the agreement. 3. Agreement to be filed and registered as suit (1) The agreement, if framed in accordance with the rules hereinbefore contained, may be filed1[with an application] in the Court which would have jurisdiction to entertain a suit, the amount or value of the subject-matter of which is the same as the amount of value of the subject-matter of the agreement. Title: Power to Make Rules

1[Power to make rules (1) The Central Government may, by notification in the Official Gazelle, make rules to carry out the purposes of this Act. (2) In particular, and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely :-- 2[* * * *] (a) the authority by which and the manner in which the duties of customs leviable under this Act shall be collected on any produce specified in the First Schedule which is exported3[by land or inland water;] (b) any other matter which is required to be, or may be prescribed. ________________________ 1. Produce Cases Act, 1966 Section 22

Title: Rules to Be Laid Before Parliament

State: Central

Every rule made under this Act shall be laid as soon as may be after it is made, before each House of Parliament while it is in session, for a total period of thirty days which may be comprised in one session or in1[two or more succasesive sessions, and if before the expiry of the session immediately following the session] in which it is laid or the succasesive sessions aforesaid, both Houses agree in making any modification in the rule or both Houses agree that the rule should not be made, the rule shall thereafter have effect only in such modified form or be of no effect as the case may be; so, however, that any such modification or annulment shall be without prejudice to the validity of anything previously done under the rule. ________________________ 1. Title: Collection of Cases on Any Produce Specified in First Schedule

.....manner as may be prescribed, and, until so prescribed, such duly of customs shall be levied and collected in accordance with the law in force immediately before the commencement of this Act. THE MULKI RULES (REPEAL) ACT, 1973 [Act, No. 68 of 1973] [28th December, 1973] PREAMBLE An Act to provide for the repeal of Mulki Rules. BE it enacted by Parliament in the Twenty-fourth Year of the Republic of India as follows:-- 1. Short title and commencement.-- (1) This Act may be called the Mulki Rules (Repeal) Act, 1973. (2) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint. 2. Definition.-- In this Act, "Mulki Rules" shall have the same meaning as in the Mulki Rules Act, 1972 (79 of 1972). 3. Repeal of Mulki Rules.-- Upon the commencement of this Act, the Mulki Rules as in force immediately before such commencement shall, notwithstanding anything contained in the Mulki Rules Act, 1972, (79 of 1972) cease to have effect and are hereby repealed: Provided that such repeal shall not affect the validity of any appointment previously made in accordance with those rules.
