THE MAHARASHTRA UNIVERSITIES ACT, 1994 THE MAHARASHTRA UNIVERSITIES ACT, 1994 Act No. XXXV of 1994 July, 1994 As Amended by Maharashtra Universities Act LV of 2000 w.e.f. 12.5.2000 An Act to unify, consolidate and amend the law relating to the non-agricultural and non-technological universities in the State of Maharashtra. WHEREAS IT is expedient to provide for a unified pattern for the constitution and administration of non-agricultural and non-technological universities in the State of Maharashtra and to make better provisions thereof ; AND WHEREAS with a view to consider and recommend measures for better governance of such universities and reorganisation of higher education, the Central Government and the Government of Maharashtra had appointed various commit tees and study groups; AND WHEREAS after considering the recommendations made by these committees and groups, and the experience gained in implementing the present university Acts, it is felt necessary to make provisions to enable each university to effectively carry out with responsibility the objects of the university, to promote more equitable distribution of facilities for higher education, to provide for.....

MAHARASHTRA (VIDARBHA REGION) AGRICULTURAL DEBTORS RELIEF ACT, 1969 MAHARASHTRA (VIDARBHA REGION) AGRICULTURAL DEBTORS RELIEF ACT, 1969 18th April 1969 An Act to provide for the relief of certain agricultural debtors in the Vidarbha region of the State of Maharashtra. WHEREAS, it is expedient to provide for the relief of certain agricultural debtors in the Vidarbha region of the State of Maharashtra ; It is hereby enacted in the Twentieth Year of the Republic of India as follows :- CHAPTER 01: PRELIMINARY SECTION 01: SHORT TITLE, EXTEND AND COMMENCEMENT (1) This Act may be called the Maharashtra (Vidarbha Region) Agricultural Debtors Relief Act, 1969. (2) It extends to the Vidarbha region of the State of Maharashtra. (3) It shall be deemed to have come into force on the 7th day of March 1969. .....Act, 1993.-The provisions made for recovery of debts of a bank is an essential aspect of the banking business. Therefore, the purpose of the 1949 Act and the 1993 Act is the same, namely regulation and control of the banking business and therefore, assuming that it is only by virtue of fiction created by section 56 of 1949 Act, that a Co-operative Bank becomes a banking company, then also a Co-operative Banks will have to be included within the meaning of definition of the term "banking company". The Full Bench of Bombay High Court further held, that so far as the aspect of business of banking is concerned, the Co-operative Banks and the companies doing business of banking are in one class. Recovery of dues is an essential aspect of the business of banking and therefore, so far as the aspect of recovery of dues of the banks are concerned, the Co-operative Banks and the companies doing business of banking would be in one class and therefore, they will have to be similarly treated.
