EAST PUNJAB URBAN RENT RESTRICTION ACT, 1949 EAST PUNJAB URBAN RENT RESTRICTION ACT, 1949 An Act to restrict the increase of rent of certain premises situated within the limits of urban areas, and the eviction of tenants therefrom It is hereby enacted as follows:- 1. Short title, extent and commencement. - (1) This Act may be called the East Punjab Urban Rent Restriction Act, 1949. (2) It extends to all urban areas in 1[Punjab] but nothing herein contained shall be deemed to affect the regulation of house accommodation in any Cantonment area. (3) It shall come into force at once. Footnotes: 1. Substituted for "East Punjab" by the Adaptation of Laws Order, 1950. 2. Definitions . - In this Act, unless there is anything repugnant in the subject or context:- (a)"building" means any building or part of a building let for any purpose whether being actually used for that purpose or not, including any land, go-downs, out-houses, or furniture let therewith, but does not include a room in a hotel, hostel or boarding-house; (b) "Controller" means any person who is appointed by the 1[State] Government to perform the functions of a Controller under this Act: .....

THE PUNJAB URBAN RENT RESTRICTION ACT, 1947 THE PUNJAB URBAN RENT RESTRICTION ACT, 1947 [Act No. 6 of 1947] PREAMBLE An Act to restrict the increase of rent of certain premises situated within the limits of urban areas, and the eviction of tenants therefrom. Whereas, the Governor of the Punjab has by a proclamation under Section 93 of the Government of India Act, 1935, assumed to himself all powers vested by or under the said Act in the Provincial Legislature : Now, therefore, in exercise of the powers so assumed to himself, the Governor is pleased to enact as follows :- Section 1 - Short title, extent and commencement (1) This Act may be called the Punjab Urban Rent Restriction Act, 1947. (2) It extends to all urban areas in the Punjab, but nothing herein contained shall be deemed to affect the regulation of house accommodation in any cantonment area. (3) It shall come into force on the 15th April, 1947. It is hereby enacted as follows :- Section 1 - Short title This Act may be called the East Punjab Urban Rent Restriction (Amendment) Act, 1950. Section 2 - Amendment of Section 13 of East Punjab Act III of 1949 To sub-section (1) of Section 13 of the East Punjab Urban Rent Restriction Act, 1949, the following words shall be added and shall be deemed to have been added since the commencement of the Act, namely :- "On in pursuance of an order made under Section 13 of the Punjab Urban Rent Restriction Act, 1947, as subsequently amended." Section 3 - Repeal of Punjab Ordinance No. VI of 1950 The East Punjab Urban Rent Restriction (Amendment) Ordinance, 1950, is hereby repealed but notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under the said Ordinance shall be deemed to have been done or taken in exercise of the powers conferred by or under this Act. .....

Be it enacted by the Legislature of the State of Punjab in the Seventeenth Year of the Republic of India as follows :- Section 1 - Short title This Act may be called the East Punjab Urban Rent Restriction (Amendment) Act, 1966. Section 2 - Amendment of section 13 of Punjab Act 3 of 1949 In section 13 of the East Punjab Urban Rent Restriction (Amendment) Act, 1949,- (1) in sub-section (3),- (a) after sub-paragraph (i) of paragraph (a), the following sub- paragraph shall be inserted, namely :- "(i-a) in the case of a residential building, if the landlord is a member of the armed forces of the Union of India and requires it for the occupation of his family and if he produces a certificate of the prescribed authority, referred to in section 7 of the Indian Soldiers (Litigation) Act, 1925, that he is serving under serving under special conditions within the meaning of section 3 of that Act.
