Be it enacted by Parliament in the Fiftieth Year of the Republic of India as follows: STATEMENT OF OBJECTS AND REASONS 1. The insurance industry requires a high degree of regulation. The Insurance Act, 1938 provides for the institution of the Controller of Insurance to act as a strong and powerful supervisory and regulatory authority with powers to direct, advise, caution, prohibit, investigate, inspect, prosecute, search, seize, fine, amalgamate, authorise, register and liquidate insurance companies. However, after the nationalisation of the life insurance industry in 1956 and the general insurance industry in 1972, the role of the Controller of Insurance diminished in significance over a period of time. 2. In April, 1993, the Government set up a high-powered Committee headed by Shri R.N. Malhotra, former Governor, Reserve Bank of India, to examine the structure of the insurance industry and recommend changes to make it more efficient and competitive keeping in view the structural changes in other parts of the financial.....

.....papers, receipts, vouchers, survey reports or other documents, belonging to an intermediary are likely to be tampered with, falsified or manufactured, it may authorise any officer of the Authority, not below the rank equivalent to that of a Gazetted Officer of the Government (hereafter referred to as the authorised officer), to- (i) enter and search any building or place where he has reason to suspect that such books, accounts or other documents, or any books or papers relating to any claim, rebate or commission or any receipts, vouchers, reports or other documents are kept; (ii) break open the lock of any box, locker, safe, almirah or other receptacle for exercising the powers conferred by clause (i) where the keys thereof are not available; (iii) seize all or any such books, accounts or other documents, found as a result of such search; (iv) place marks of identification on such books, accounts or other documents or make or cause to be made extracts or copies therefrom. (2) The authorised officer may requisition the services of any police officer or of any officer of the Central Government, or of both, to assist him for all or any of the purposes specified.....

Section 9 - Vacancies, etc., not to invalidate proceedings of the Board No act or proceeding of the Board shall be invalid merely by reason of-- (a) any vacancy in, or any defect in the constitution of, the Board; or (b) any defect in the appointment of a person acting as a member of the Board; or (c) any irregularity in the procedure of the Board not affecting the merits of the case. Amendment of section 2 In the Electricity Regulatory Commissions Act, 1998 (14 of 1998) (hereinafter referred to as the principal Act), in section 2, -- (a) In clause (c), for the words or the State Commission, the words or the State Commission or the Joint Electricity Regulatory Commission shall be substituted; (b) After clause (e), the following clause shall be inserted, namely: -- (ea) Joint Electricity Regulatory Commission means the Joint Electricity Regulatory Commission constituted under section 21A; 3.Insertion of new Chapter IVA After Chapter IV of the principal Act, the following Chapter shall be inserted, namely: -- CHAPTER IVA JOINT ELECTRICITY REGULATORY COMMISSION 21A. Constitution of Joint State Commission (1) Notwithstanding anything contained in this Act, an agreement may be entered into (a) by two or more State Governments, (b) by the Central Government (in respect of one or more Union territories) and one or more State Governments, to be in force for such period and to be subject to renewal for such further period, if any, as may be specified in the agreement to provide for the constitution of a Joint Electricity.....
