.....of the Board with respect to any matter in which he has such interest or is so interested. Section 14 Defects in appointment not to invalidate acts etc No act or proceeding of the Board or of any Committee of the Board shall be invalid merely by reason of (a) any vacancy therein or any defect in the constitution thereof; or (b) any disqualification, or any defect in the appointment, of a person acting as a member thereof; or (c) any member having acted or taken part in any proceedings in contravention of the provisions of section 13; or (d) any irregularity in its procedure not affecting the merits of the case. Section 15 Delegation of powers The Board may, with the approval of the State Government, direct that (a) such of the powers and duties conferred or imposed upon the Board by or under this Act as may be specified in such direction may also be exercised or performed by the Chairman, or (b) such of the powers and duties conferred or imposed on the Chairman by or under this Act as may be specified in such direction may also be exercised or performed by the Vice-Chairman, subject to such conditions and restrictions as may be specified in such direction: Provided.....

Title: Application for Registration

(1) Any person claiming to be the creator of a layout-design, who is desirous of registering it, shall apply in writing to the Registrar in the prescribed manner for the registration of his layout-design. (2) Every application under sub-section (1) shall be filed in the office of the Semiconductor Integrated Circuits Layout-Design Registry within whose territorial limits the principal place of business in India of the applicant or in the case of joint application the principal place of business in India of the applicant whose name is first mentioned in the application, as having a place of business in India, is situate: Provided that, where the applicant or any of the joint applicant does not carry on business in India, the application shall be filed in the office of the Semiconductor Integrated Circuits Layout-Design Registry within whose territorial limits the place mentioned in the address for service in India as disclosed in the application is situate. (3) Subject to the provisions of this Act, the Registrar may refuse the application or may accept it absolutely or subject to such amendments or modifications, as he may think fit.

Title: Procedure for and Duration of Registration

.....Be it enacted by Parliament in the Fifty-first Year of the Republic of India as follows:- SECTION 01: SHORT TITLE, EXTENT AND COMMENCEMENT (1) This Act may be called the Designs Act, 2000 (2) It extends to the whole of India. (3) It shall come into force on such date as the Central Government may, by notification in the Official Gazette, appoint; and different dates may be appointed for different provisions of this Act, and any reference in any such provision to the commencement of this Act shall be construed as a reference to the coming into force of that provision. Title: Powers and Duties of Controller

Section 35 - Refusal to register a design in certain cases (1) The Controller may refuse to register a design of which the use would, in his opinion, be contrary to public order to morality. (2) An appeal shall lie to the High Court from an order of the Controller under this section. Section 36 - Appeals to the High Court (1) Where an appeal is declared by this Act to lie from the Controller to the High Court, the appeal shall be made within three months of the date of the order passed by the Controller. (2) In calculating the said period of three months, the time (if any) occupied in granting a copy of the order appealed against shall be excluded. (3) The High Court may, if it thinks fit, obtain the assistance of an expert in deciding such appeals, and the decision of the High Court shall be final. (4) The High Court may make rules consistent with this Act as to the conduct and procedure of all proceedings under this Act before it.
