.....In the circumstance Government, considered it essential to take powers to coerce the recalcitrant minority which usually sets itself up in opposition against the wishes of the majority. As the necessity for the prevention of damage to crops in insect pests and plant diseases still exists, it appeared desirable to re-enact this Act.--Statement of Objects and Reasons. _________________ 1. This Act was extended to the rest of the State of Maharashtra (vide Mah. 4 of 1962, s. 2). 2. For Statement of Objects and Reasons, see Bombay Government Gazette, 1947, Part V, page 245; for Proceedings in Assembly, see Bombay Legislative Assembly Debates, 1947, Vol. XI; and for Proceedings in Council, see Bombay Legislative Council Debates, 1947, Vol. XIII. 3. This indicates the date of commencement of Act. 4. These words were substituted for the words "Province of Bombay" by Mah. 4 of 1962, ss. 3 and 4. 5. The portion beginning with "in view of the provisions" and ending with "1935" was deleted, ibid., s. 4 (a).

Reciprocity Act, 1943 Complete Act

.....to interfere in spite of our strong protest against discriminating legislation. As negotia- tions have frequently failed to achieve any satisfactory settlement with some of the recalcitrant British possessions nothing remains but to put into effect the principles of reciprocity which is the object of this Bill. The Bill if passed into law will provide a sanction - though not as effective as the economic - to the Government of India whenever negotiations with an (offending country in the British Empire fail. The permanent solution of our troubles can only be achieved when India enjoys the same freedom as South Africa or Great Britain." Govind V. Deshmukh.-Gaz. ofind., 1941, Part V, page 162. An Act to make provisions on a basis of reciprocity in regard to entry into, travel, residence, the - acquisition, holding or disposal of property, the enjoyment of educational facilities, the hold- ing of public office, or the carrying on of any occupation, trade, business or profession in 2[* * *] India by, and the franchise in2[* * *] India of, persons domiciled in British possessions. Preamble WHEREAS it is expedient to make provisions on a basis of reciprocity in regard to entry.....

.....any tax, duty, penalty, fine, interest, annuity deposit or any other sum payable to the Government by an assessee under that Act; (c) "scheduled Act" means an Act specified in the Schedule; (d) "Taxing Authority", in relation to any scheduled Act, means an officer (by whatever name called) empowered to serve upon an assessee a notice of demand in respect of any Government dues under that Act; (e) "Tax Recovery Officer", in relation to any scheduled Act, means a Tax Recovery Officer as defined in that Act and where there is no such definition, means an officer (by whatever name called) to whom a certificate for the recovery of arrears of Government dues may be issued under that Act. SECTION 03: CONTINUATION AND VALIDATION OF CERTAIN PROCEEDINGS (1) Where any notice of demand in respect of any Government dues is served upon an assessee by a Taxing Authority under any scheduled Act, and any appeal or other proceeding is filed or taken in respect of such Government dues, then,- (a) where such Government dues arc enhanced in such appeal or proceeding, the Taxing Authority shall serve upon the assessee another notice of demand only in respect of the amount by which such Government.....
