.....In the circumstance Government, considered it essential to take powers to coerce the recalcitrant minority which usually sets itself up in opposition against the wishes of the majority. As the necessity for the prevention of damage to crops in insect pests and plant diseases still exists, it appeared desirable to re-enact this Act.--Statement of Objects and Reasons. _________________ 1. This Act was extended to the rest of the State of Maharashtra (vide Mah. 4 of 1962, s. 2). 2. For Statement of Objects and Reasons, see Bombay Government Gazette, 1947, Part V, page 245; for Proceedings in Assembly, see Bombay Legislative Assembly Debates, 1947, Vol. XI; and for Proceedings in Council, see Bombay Legislative Council Debates, 1947, Vol. XIII. 3. This indicates the date of commencement of Act. 4. These words were substituted for the words "Province of Bombay" by Mah. 4 of 1962, ss. 3 and 4. 5. The portion beginning with "in view of the provisions" and ending with "1935" was deleted, ibid., s. 4 (a).

.....to interfere in spite of our strong protest against discriminating legislation. As negotia- tions have frequently failed to achieve any satisfactory settlement with some of the recalcitrant British possessions nothing remains but to put into effect the principles of reciprocity which is the object of this Bill. The Bill if passed into law will provide a sanction - though not as effective as the economic - to the Government of India whenever negotiations with an (offending country in the British Empire fail. The permanent solution of our troubles can only be achieved when India enjoys the same freedom as South Africa or Great Britain." Govind V. Deshmukh.-Gaz. ofind., 1941, Part V, page 162. An Act to make provisions on a basis of reciprocity in regard to entry into, travel, residence, the - acquisition, holding or disposal of property, the enjoyment of educational facilities, the hold- ing of public office, or the carrying on of any occupation, trade, business or profession in 2[* * *] India by, and the franchise in2[* * *] India of, persons domiciled in British possessions. Preamble WHEREAS it is expedient to make provisions on a basis of reciprocity in regard to entry.....

.....be necessary for the Taxing Authority to serve upon the' asses- see a fresh notice of demand; (ii) the Taxing Authority shall give intimation of the fact of such reduction to the assessee, and where a certificate has been issued to the Tax Recovery Officer for the recovery of such amount, also to that officer; (iii) any proceedings initiated on the basis of the notice or notices of demand served upon the assessee before the disposal of such appeal or proceeding may be continued in relation to the amount so reduced from the stage at which such proceedings stood immediately before such disposal; (c) no proceedings in relation to such Government dues (including the imposition of penalty or charging of interest) shall be invalid by reason only that no fresh notice of demand was served upon the assessee after the disposal of such appeal or proceeding or that such Government dues have been enhanced or reduced in such appeal or proceeding: Provided that if as a result of any final order such Government dues (other than annuity deposit) have been reduced and the penalty imposed on the assessee for default in payment thereof exceeds the amount so reduced the excess shall not be re-.....
