The Punjab Requisitioning and Acquisition of Movable Property Act, 1978 Complete Act

.....assigned to it in clause (18) of section 2 of the Motor Vehicles Act, 1939, 1930; (e) "prescribed" means prescribed by rules made under this Act. Section 3 - Power to requisition Movable property (1) Whereas the competent authority is of the opinion that it is necessary or expedient so to do for the maintenance or improvement of services and supplies essential to the life of the community or for providing immediate relief to persons affected by floods or any other natural calamity, riots or strikes or for the efficient conduct of election, or for any other public purpose, it may, by an order in writing, requisition any moveble property and may make such further orders as appear to it to be necessary or expedient in connection with the requisition : Provided that no property used for the purpose of religious worship, no motor vehicle operating on an inter-State permit in the inter- State permit of such vehicle and no aircraft or anything forming part of an aircraft or connected with the operation, repair or maintenance of aircraft, shall be requisitioned. Title: Order for Disposal of Property Regarding Which Offence is Committed

.....or document produced before the court or in its custody, or regarding which any offence appears to have been committed or which has been used for the commission of any offence. (2) Where any order has been made under sub-section (1) in respect of property regarding which an offence appears to have been committed, a copy of such order signed and certified by the authority making the same may, whether the trial was held within India or not be sent to a Magistrate within whose jurisdiction such property for the time being is situated, and such Magistrate shall thereupon cause the order to be carried out into effect as if it were an order passed by him under the provisions of the Code of Criminal Procedure, 1973. (3) In this section, the term "property" includes, in the case of property regarding which an offence appears to have been committed, not only such property as has been originally in the possession or under the control of any person, but also any property into or for which the same may have been converted or exchanged, and anything acquired by such conversion or exchange whether immediately or otherwise.

Coast Guard Act, 1978 Section 34

Title: Offences in Respect of Property

State: Central

Year: 1978

Any person subject to this Act who commits any of the following offences, that is to say,-- (a) commits theft of any property belonging to the Government or to any Coast Guard mess, or institution, or to any person subject to this Act or (b) dishonestly misappropriates or converts to his own use any such property; or (c) commits criminal breach of trust in respect of any such property; or (d) dishonestly receives or retains any such property in respect of which any of the offences under clauses (a), (b) and (c) has been committed, knowing or having reason to believe the commission of such offence; or (e) wilfully destroys or damages any property of the Government entrusted to him; or (f) does any other thing with intent to defraud or to cause wrongful gain to one person or wrongful loss to another person. shall, on conviction by a Coast Guard Court, be liable to suffer imprisonment for a term which may extend to ten years or such less punishment as is in this Act mentioned.

Title: Duty to Deliver Possession of Properties, Etc.

(1) Where any property appertaining to any of the undertakings of the dissolved company has been transferred to, and vested in, the Steel Authority of India,- (a) every person in whose possession, custody or control any such property may be, shall on demand by the Steel Authority of India, forthwith deliver the property to the Steel Authority of India or to such person as the Steel Authority of India may authorities in this behalf; (b) any person who, immediately before such vesting, has in his possession, custody or control, any books, documents or other papers relating to any of the undertakings of the dissolved company shall be liable o account for the said books documents, and appears to he Steel authority of India and shall deliver them to the steel authority of India or to such person as the steel authority of India may authorise in this behalf. (2) Without prejudice to the other provisions contained in this section, it shall be lawful for the steel Authority of India to take all necessary steps for taking possession of all properties, which have been transferred to, and vested in, it under this Act. Coast Guard Act, 1978 Section 93

Title: Order for Custody and Disposal of Property Pending Trial

State: Central

Year: 1978

When any property regarding which any offence appears to have been committed, or which appears to have been used for the commission of any offence, is produced before a Coast Guard Court during a trial, the court may make such order as it thinks fit for the proper custody of such property pending the conclusion of the trial, and if the property is subject to speedy or natural decay may, after recording such evidence as it thinks necessary, order it to be sold or otherwise disposed of.

Title: Duty to Deliver Possession of Property Acquired and Documents Relating Thereto

.....Company in the State Government under section 6, every person in whose possession or custody or under whose control any property referred to in sub-section (1) of section 4 may be, shall deliver the property to the State Government forthwith. (2) Any person, Who on the appointed day has in his possession or under his control any books, documents or other papers relating to the undertakings of the Company which has vested in the State Government under section 6 and which belong to the Company, or, would have so belonged if the undertakings of the Company had not vested in the State Government, shall be liable to account for the said books, documents or other papers to the State Government and shall deliver them up to the State Government. (3) The State Government may take or cause to be taken, all necessary steps for securing possession of all properties which have vested in that Government under this Act. (4) The Central Government may issue such directions as it may deem desirable in the circumstances of the case to the State Government as to its powers and duties and the State Government may also, if it so desires, apply to the Central Government at any time for.....

Title: Damage to Property

Any person subject to this Act, who commits any act which causes damage to, or destruction of, any property of the Government shall, on conviction by a Coast Guard Court, be liable to suffer imprisonment for a term whcih may extend to seven years or such less punishment as is in this Act mentioned.
