The Goa, Daman and Diu Labour Welfare Fund Act, 1986 Complete Act

.....or by any other name, such other persons; (e) ˜establishment' means any" (i) factory as defined in clause (m) of section 2 of the Factories Act, 1948 (Central Act 53 of 1948), or any place which is deemed to be a factory under section 85 of that Act, or (ii) motor transport undertaking as defined in clause (g) of section 2 of the Motor Transport Workers Act, 1961 (Central Act 27 of 1961), or (iii) establishment, including a society registered under the Societies Registration Act, 1860 (Central Act 21 of 1860), and a charitable or other trust whether registered under any law applicable to such charitable or other trust or not, which carries on any business or trade or any work in connection therewith or ancillary thereto but does not include an establishment not being a factory which is a unit or department of the Central or any State Government, or (iv) establishment as defined under sub-section (9) of section 2 of the Goa, Daman and Diu Shops and Establishments Act, 1973 (Act 13 of 1974), or (v) establishment of a contractor, or (vi) scheduled employment as defined in clause (g) of section 2 of the Minimum Wages Act, 1948 (Central Act 11 of 1948), or .....

.....in the gazette No. 42 dated 18-1-88) shall have power to take, for the purpose of analysis, samples of air, water, soil or other substance from any factory, premises or other substance from any factory, premises or other place in such manner as may be prescribed. (For procedure for taking samples see r.6 of Environment (Protection)Rules 1986 also) (2) The result of any analysis of a sample taken under sub-section (1) shall not be admissible in evidence in any legal proceeding unless the provisions of sub- sections (3) and (4) are complied with. (3) Subject to the provisions of sub-section (4), the person taking 'the sample under sub-section (1) shall- (a) serve on the occupier or his agent or person in charge of the place, a notice, then and there, in such form as may be prescribed, of his intention to have it so analysed; (b) in the presence of the occupier or his agent or person, collect a sample for analysis; (c) cause the sample to be placed in a container or containers which shall be marked and scaled and shall also be signed both by the person taking the sample and the occupier or his agent or person; (d) send without delay, the container or the containers to.....

Venture Capital Fund (1) There shall be formed for the purposes of this Act a Fund to be called the Venture Capital Fund and such Fund shall form part of the Development Assistance Fund established by the Development Bank under section 14 of the Industrial Development Bank of India Act, 1964 (18 of 1964), and the provisions of Chapter V of that Act shall, save as otherwise expressly provided in this Act, apply to such Fund. (2) There shall be credited to the Fund- (a) all amounts paid under section 4; (b) any amount given as grants by the Central Government for the purposes of this Act; c) any amount given to the Fund from any other source: and (d) any income from investment of the amount in the Fund."

Karnataka Marine Fishing (Regulation) Act, 1986. Section 5

Title: Licencing of Fishing Vessels

(4) In granting or refusing licence under sub-section (3), the authorised officer shall have regard to the following matters, namely : - (a) the condition of the fishing vessel including the accessories and fishing gear with which it is fitted; (b) any order that may be made under section 3 ; (c) any other matter that may be prescribed. (5) A licence granted under this section shall be in such form and be subject to such conditions including conditions as to payment of such fees and furnishing such security for the due performance of the conditions as may be prescribed : Provided that different fees and different amounts by way of security, may be prescribed in respect of licences for different classes of fishing vessels. (6) A licence granted under this section shall be valid for a period of three years and may be renewed for a similar period on payment of the fee specified under sub-section (5).

Child Labour (Prohibition and Regulation) Act, 1986 Section 5

Title: Child Labour Technical Advisory Committee

.....notification in the official Gazette,constitute an advisory committee to be called the Child Labour Technical Advisory Committee (hereafter in this section referred to as the Committee) to advise the Central Government for the purpose of addition or occupations and processes to the Schedule. (2) The Committee shall consist of a Chairman and such other members not exceeding ten, as may be appointed by the Central Government. (3) The Committee shall meet as often as it may consider necessary and shall have power to regulate its own procedure. (4) The Committee may, if it deems it necessary so to do, constitute one or more sub-committees and may appoint to any such sub-committee, whether generally or for the consideration of any particular matter, any person who is not a member of theCommittee. (5) The term of office of, the manner of filling casual vacancies in the office of, and the allowances, if any, payable to, the Chairman and other members of the Committee, and the conditions and restrictions subject to which the Committee may appoint any person who is not a member of the Committee as a member of any of its sub-committees shall be such as may be prescribed.

Co-operative Textile Mills (Acquisition and Transfer) Act, 1986 Section 5

Title: General Effect of Vesting

.....to claim in accordance with his rights and interest, payment of the mortgage money or other dues in whole or in part out of the amount specified in section 9 and also out of the amount determined under section 10 but no such mortgage, charge, lien or other interest shall be enforceable against any property which has vested in the Government. (5) Any licence or other instrument granted to the lessor or lessee in relation to the mills which has vested in the Government under section 4, at any time before the appointed day and in force immediately before that day shall continue to be in force on and after such day in accordance with its tenor in relation to and for the purposes of the mills, and on and from the date of vesting of the mills under section 8 in the Company, the Company shall be deemed to be substituted in such licence or other instrument in place of the lessor or lessee referred to therein as if such licence or other instrument had been granted to the Company and the Company shall hold it for the remainder of the period for which the lessor or lessee would have held it under the terms thereof. Co-operative Textile Mills (Acquisition and Transfer) Act, 1986 Chapter V

Title: Commissioner of Payments

.....within the meaning of sections 193 and 228 of the Indian Penal Code and the Commissioner shall be deemed to be a Civil Court for the purposes of section 195 and Chapter XXVI of the Code of Criminal Procedure, 1973. (7) A claimant who is dissatisfied with the decision of the Commissioner may prefer an appeal against the decision to the District Court within the local limits of whose jurisdiction the Mills is situated. Section 22 - Disbursement of the amount by the Commissioner to the claimants (1) After admitting a claim under this Act the amount due in respect of such claim shall be paid by the Commissioner to the person or persons to whom such amount is due and on such payment the liability of the mills in respect of such claims shall stand discharged. Section 23 - Undisbursed or unclaimed amount to be deposited to the General Revenue Account Any amount paid to the Commissioner which remains undisbursed or unclaimed on the date immediately preceding the date on which the office of the Commissioner is finally wound up, shall be transferred by the Commissioner to the General Revenue Account of the Government, but a claim to any amount so transferred may be preferred.....

National Security Guard Act 1986 Section 5

Title: Control, Direction, Etc.

(1) The general superintendence, direction and control of the Security Guard shall vest in, and be exercised by, the Central Government and subject thereto and to the provisions of this Act and the rules, the command and supervision of the Security Guard shall vest in an officer to be appointed by the Central Government as the Director-General of the Security Guard. (2) The Director-General shall, in the discharge of his duties under this Act, be assisted by such number of Additional Directors-General, Inspectors-General, Deputy Inspectors-General, Group Commanders and other officers as may be appointed by the Central Government.

Swadeshi Cotton Mills Company Limited (Acquisition and Transfer of Undertakings) Act, 1986 Section 5

Title: Company to Be Liable for Certain Prior Liabilities

.....of the Company and shall be enforceable against it and not against the Central Government of the National Textile Corporation. (2) For the removal of doubts, it is hereby declared that, (a) save as otherwise expressly provided in this section or in any other section of this Act, no liability of the Company in relation to the textile undertakings, in respect of any period prior to the appointed day shall be enforceable against the Central Government or the National Textile Corporation; (b) no award, decree or order of any court, tribunal or other authority in relation to any textile undertaking, passed after the appointed day, in respect of any matter, claim or dispute which arose before that day shall be enforceable against the Central Government or the National Textile Corporation; (c) no liability incurred by the Company in relation to any textile undertaking before the appointed day, for the contravention of any provision of law for the time being in force, shall be enforceable against the Central Government or the National Textile Corporation.
