Title: Fund, Accounts and Audit

.....it by the Central Government and all other receipts (by way of contributions, it any, form the State Government, fees, gifts, grants, donations, benefactions or otherwise) of that Board shall be carried to the fund of the Board and all payments by the Board shall be made therefrom. (2) Every State Board may expend such sums as it thinks fit for performing its functions under this Act and such sums shall be treated as expenditure payable out of the fund of that Board. (3) Nothing in this section shall apply to any1[State Pollution Control Board] constituted under section 4 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974), which is empowered by that Act to expend money form its fund thereunder also for performing its functions, under any law for the time being in force relating to the prevention, control or abatement of air pollution. ________________________ 1. .....Act 38 of 1959) or any corresponding new bank constituted under section 3 of the Banking Companies (Acquisition and Transfer of Undertakings) Act 1970 (Central Act 5 of 1970) or any corresponding new bank constituted under section 3 of the Banking Companies (Acquisition and Transfer of Undertakings) Act, 1980 (Central Act 40 of 1980),- (a) to produce any book of account or other documents which the Reserve Bank of India, the State Bank of India, the subsidiary bank or the corresponding new bank claims to be of a confidential nature, or (b) to make any such book or document a part of the record of the proceedings of the departmental inquiry, or (c) to give inspection of any such book or document, if produced, to any party before it or to any other person. (3) Every process issued by an authorised inquiring authority for the attendance of any witnessor for the production of any document shall be served and executed through the District Judge within the local limits of whose jurisdiction the witness or other person, on whom the process is to be served or executed, voluntarily resides or carries on business or personally works for gain, and, for the purposes of taking.....

Title: Duties of Conciliation Officers

.....shall, as soon as practicable, after the close of the investigation, send to the Central Government a full report setting forth the steps taken by him for ascertaining the facts and circumstances relating to the dispute and for brining about a settlement thereof, together with a full settlement of such facts and circumstances and the reasons on account of which, in his opinion a settlement could not be arrived at. (5) If, on a consideration of the report referred to in sub-section (4), the Central Government is satisfied that there is case for reference to a Tribunal, it may make such reference under section 11 and where that Government does not make such reference, it shall record and communicate to the parties concerned its reasons therefor. (6) A report under this section shall be submitted within three months of the commencement of the conciliation proceedings or within such shorter period as may be fixed by the Central Government: Provided that, subject to the approval of the conciliation officer, the time for the submission of the report may be extended by such period as may be agreed upon in writing by all the parties to the dispute.

Title: Prohibition of Fishing by Indian Citizens, Etc., Using Foreign Vessels

.....may be prescribed and to such additional conditions and restrictions as may be specified therein. (6) A person holding a permit under this section shall ensure that every person employed by him complies, in the course of such employment, with the provisions of this Act or any rule or order made thereunder and the conditions of such permit. (7) Notwithstanding anything contained in the foregoing provisions of this section, or in section 3, any permission granted to an Indian citizen to use or employ foreign fishing vessels in any maritime zone of India and in force immediately before the commencement of this Act shall, if the terms and conditions of such permission are not inconsistent with the provisions of this Act, be deemed to be a permit granted under this section and such permission shall continue to be in force after such commencement on the same terms and conditions, including the conditions as to the area of operation and the period of its validity, and the provisions of this Act shall, so far as may be, apply to such permission.

National Bank for Agriculture and Rural Development Act, 1981 Section 5

.....as otherwise provided in the regulations made under this Act, the Managing Director shall also have powers of general superintendence, direction and management of the affairs and business of the National Bank and may also exercise all powers and do all acts and things which may be exercised or done by the National Bank. (4) Any whole-time director appointed under sub-section (3) of section 6 shall assist the Managing Director in the discharge of his functions under sub-section (3) and perform such duties as the Board may entrust or delegate to him. (5) In the discharge of his powers and functions under sub-section (3) the Managing Director shall follow such directions as the Chairman may give. (6) In the discharge of its functions under this Act, the National Bank shall be guided by such directions in matters of policy involving public interest as the Central Government in consultation with the Reserve Bank, or the Reserve Bank may give in writing.

In the Income-tax Act-- (a) in section 2, in clause (14), after sub-clause (iv), the following sub-clause shall be inserted, namely:-- "(v) Special Bearer Bonds, 1991, issued by the Central Government;"; (b) in section 10, in clause (15), after sub-clause (ia), the following sub-clause shall be inserted, namely:-- "(ib) premium on the redemption of Special Bearer Bonds, 1991;".

KARNATAKA TODDY WORKERS' WELFARE FUND ACT, 1981 Section 5

Title: Constitution of the Board

.....a Board to be called the Karnataka Toddy Workers' Welfare Fund Board for the purpose of the administration of the Fund and to supervise or carry out the activities financed from and out of the Fund. (2) The Board shall be a body corporate by the name aforesaid, having perpetual succession and a common seal and shall, by the said name, sue and be sued. (3) The Board shall consist of such number of directors as may be appointed by notification in the official Gazette by the State Government, out of whom at least one shall be a person belonging to scheduled caste and one shall be from among toddy tappers and they shall be, chosen in such manner as may be provided for in the Scheme : Provided that the Board shall include an equal number of directors representing the State Government, the employers and the employees. (4) One of the directors of the Board shall be appointed by the State Government as Chairman. (5) Subject to the pleasure of the State Government the term of office of the Chairman and other members of the Board shall be three years. (6) The Board shall administer the Fund vested in it in such manner as may be specified in the Scheme.

Title: Amendment of Section 32a

In section 32A of the Income-tax Act, in clause (2) of the Explanation below sub-section (2), for the words "the business of the undertaking does not exceed ten lakh rupees; and for this purpose the value of any machinery or plant shall be, -", the following shall be substituted, namely :- "the business of the undertaking does not exceed, - (i) in a case where the previous year ends before the 1st day of August, 1980, ten lakh rupees; and (ii) in a case where the previous year ends after the 31st day of July, 1980, twenty lakh rupees, and for this purpose the value of any machinery or plant shall be, -".
