.....under the Delhi Development Act, 1957 (61 of 1957); (f) "notification" means a notification published in the Official Gazette; (g) "punitive action" means action taken by a local authority under the relevant law against unauthorised development and shall include demolition, sealing of premises and displacement of persons or their business establishment from their existing location, whether in pursuance of court orders or otherwise; (h) "relevant law" means in case of-- (i) the Delhi Development Authority, the Delhi Development Act, 1957 (61 of 1957); (ii) the Municipal Corporation of Delhi, the Delhi Municipal Corporation Act, 1957 (66 of 1957); and (iii) the New Delhi Municipal Council, the New Delhi Municipal Council Act, 1994 (44 of 1994); (i) "unauthorised development" means use of land or use of building or construction of building or development of colonies carried out in contravention of the sanctioned plans or without obtaining the sanction of plans, or in contravention of the land use as permitted under the Master Plan or Zonal Plan or layout plan, as the case may be, and includes any encroachment. Title: Provisions of This Act Not to Apply in Certain Cases

During the period of operation of this Act, no relief shall be available under the provisions of section 3 in respect of the following encroachment or unauthorised development, namely:-- (a) encroachment on public land except in those cases which are covered under clauses (a), (b) and (c) of sub-section (1) of section 3; (b) removal of slums and Jhuggi-Jhompri dwellers, hawkers and urban street vendors, unauthorised colonies or part thereof, village abadi area (including urban villages) and its extension in accordance with the relevant policies approved by the Central Government for clearance of land required for specific public projects.

.....(AMENDMENT) ACT, 2011 THE HIMACHAL PRADESH MUNICIPAL (AMENDMENT) ACT, 2011 PREAMBLE AN ACT further to amend the Himachal Pradesh Municipal Act, 1994 (Act No. 13 of 1994). BE it enacted by the Legislative Assembly of Himachal Pradesh in the Sixty-second Year of the Republic of India as follows:-- Section 1 - Short title and commencement (1) This Act may be called the Himachal Pradesh Municipal (Amendment) Act, 2011. (2) It shall come into force on such date as the State Government may, by notification published in the Official Gazette, appoint. Section 2 - Amendment of section 2 In section 2 of the Himachal Pradesh Municipal Act, 1994 (hereinafter referred to as the 'principal Act'),-- (a) clause (1) shall be omitted.; (b) after clause (6), the following new clause shall be inserted, namely:-- "(6-a) "cattle" means domestic animals and includes elephants, camels, buffaloes, cows, oxen, horses, mares, geldings, ponies, colts, fillies, mules, asses, pigs, rams, ewes, sheep, lambs, goats and kids;"; and (c) after clause (33), the following new clause shall be inserted, namely:-- "(33-a) 'ratable value' shall mean,-- (a) In the case of land, the ratable value shall be based.....

(3) Whoever commits or abets the commission of any offence of illegal diversion or illegal colonization shall be punished with imprisonment of not less than three years and not more than seven years and with a minimum fine of one lac rupees, and the court may in passing the judgment in respect of any such offence order the accused to pay to the Municipal Corporation such amount of compensation as specified in the judgment, taking into consideration the amount required to be incurred towards the development of such illegal colony. (4) Whoever constructs a building in an area of illegal diversion or illegal colonization commits an offence of illegal construction. (5) Whoever commits an offence of illegal construction shall be punished with imprisonment of not less than three years and not more than seven years and with a minimum fine of one lac rupees. (6) It shall be incumbent upon every colonizer to display correct information about the area.....
