Title: Power to Exempt During Public Emergency

In any case of public emergency the State Government may, by notification in the Official Gazette, exempt any factory or class or description of factories from all or any of the provisions of this Act 1 [except section 67] for such period and subject to such conditions as it may think fit : Provided that no such notification shall be made for a period exceeding three months at a time. 2 [Explanation.--For the purposes of this section "public emergency" means a grave emergency whereby the security of India or of any part of the territory thereof is threatened, whether by war or external aggression or internal disturbance.] _____________________ 1. Title: Power to Intercept Postal Articles for Public Good

.....by order in writing direct that any postal article or class or description of postal articles in course of transmission by post shall be intercepted or detained, or2[shall be disposed of in such manner as the authority issuing the order may direct]. (2) If any doubt arises as to the existence of a public emergency, or as to whether any act done under sub-section (1) was in the interest of the public safety or tranquillity, a certificate3[of the Central Government or, as the case may be, of the State Government] shall be conclusive proof on the point. __________________________ 1. THE AUROVILLE (EMERGENCY PROVISIONS) ACT, 1980 [Act, No. 59 of 1980] [17th December, 1980] PREAMBLE An Act to provide for the taking over, in the public interest, of the management of Auroville for a limited period and for matters connected therewith or incidental thereto, Whereas Sri Aurobindo Society, a non-governmental organisation had been a channel of funds for the setting up of a cultural township known as Auroville, where people of different countries are expected to live together in harmony in one community and are expected to engage in cultural, educational, scientific and other pursuits aiming at human unity; And whereas the United Nations Educational, Scientific and Cultural Organisation ( hereinafter referred to as 'UNESCO'), being of the opinion that the project aforesaid would contribute to international understanding and promotion of peace, by a resolution passed in 1966, commended Auroville to those interested in UNESCO's ideals; And whereas by a further resolution passed in 1968, the UNESCO had invited its member-States and international non-governmental organisations to participate in the development of Auroville as an international cultural.....

THE AUROVILLE (EMERGENCY PROVISIONS) AMENDMENT ACT, 1987 [Act, No. 44 of 1987] [11th December, 1987] PREAMBLE An Act further to amend the Auroville (Emergency Provisions) Act, 1980 BE it enacted by Parliament in the Thirty-eighth Year of the Republic of India as follows: - 1. Short title and commencement (1) This Act may be called the Auroville (Emergency Provisions) Amendment Act, 1987. (2) It shall be deemed to have come into force on the 28th day of October, 1987. 2. Amendment of section 3 In section 3 of the Auroville (Emergency Provisions) Act, 1980 (hereinafter referred to as the principal Act), in sub-section (1), in the proviso, for the words "seven years", the words "eight years" shall be substituted. 3. Repeal and saving (1) The Auroville (Emergency Provisions) Amendment Ordinance, 1987, is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance, shall be deemed to have been done or taken under the principal Act, as amended by this Act.
