THE KERALA VALUE ADDED TAX ACT, 2003 1 THE KERALA VALUE ADDED TAX ACT, 2003 {UPDATION UPTO FINANCE ACT 2009} An Act to consolidate and amend the law relating to the levy of tax on the sale or purchase of goods based on the concept of Value Added Tax in the State of Kerala. Preamble. - Whereas it is expedient to consolidate and amend the law relating to the levy of tax on the sale or purchase of goods based on the concept of value added tax in the State of Kerala: Be it enacted in the Fifty-fourth Year of the Republic of India as follows: - CHAPTER - I PRELIMINARY 1 . Short title, extent and commencement . " (1) This Act may be called the Kerala Value Added Tax Act, 2003. (2) It extends to the whole of the State of Kerala. (3) It shall come into force on such date as the Government may, by notification in the Gazette, appoint. 2 . Definitions .- In this Act, unless the context otherwise requires, - (i)"Agriculture" with all its grammatical variations cognate expressions, includes floriculture, horticulture, the raisin of crops, grass or garden produce, and also grazing; but does not include dairy farming, poultry farming, stock.....

.....exercise of the powers vested in him under sub- section (1) of section 4 of the Himachal Pradesh Judicial Officers (Pay and Conditions of Service) Act, 2003 (Act No.10 of 2003), is pleased to make the following rules to regulate the pay of Judicial Officers, namely:- 1. Title: Provisions in Respect of Officers and Other Employees of Development Bank

.....of the Development Bank and any other bodies created for the welfare of officers or employees would continue to discharge their functions in the Company as was being done hitherto in the Development Bank and any tax exemption granted to the provident fund or the gratuity fund or pension fund would continue to be applied to the Company. (6) Notwithstanding anything contained in this Act or in the Companies Act, 1956(1 of 1956), or in any other law for the time being in force or in the regulations of the Development Bank, no director of the Board, chairman and managing director or any whole-time director or any other person entitled to manage the whole or substantial part of the business and affairs of the Development Bank shall be entitled to any compensation against the Development Bank or the Company for the loss of office or for the premature termination of any contract of management entered into by him with the Development Bank.

Electricity Act, 2003 Section 89

Title: Term of Office and Conditions of Service of Members

(4) Notwithstanding anything contained in sub-section (1), a Member may-- (a) relinquish his office by giving in writing to the Appropriate Government a notice of not less than three months; or (b) be removed from his office in accordance with the provisions of section 90. (5) Any member ceasing to hold office as such shall-- (a) not accept any commercial employment for a period of two years from the date he ceases to hold such office; and (b) not represent any person before the Central Commission or any State Commission in any manner. Explanation : For the purposes of this sub-section, "commercial employment" means employment in any capacity in any organisation which has been a party to the proceedings before the Appropriate Commission or employment in any capacity under, or agency of, a person engaged in trading, commercial, industrial or financial business in electricity industry and includes a director of a company or partner of a firm or setting up practice either independently or as partner of a firm or as an adviser or a consultant.

Electricity Act, 2003 Section 133

Title: Provisions Relating to Officers and Employees

(1) The State Government may, by a transfer scheme, provide for the transfer of the officers and employees to the transferee on the vesting of properties, rights and liabilities in such transferee as provided under section 131. (2) Upon such transfer under the transfer scheme, the personnel shall hold office or service under the transferee on such terms and conditions as may be determined in accordance with the transfer scheme: PROVIDED that such terms and conditions on the transfer shall not in any way be less favourable than those which would have been applicable to them if there had been no such transfer under the transfer scheme: PROVIDED FURTHER that the transfer can be provisional for a stipulated period. Explanation : For the purposes of this section and the transfer scheme, the expression "officers and employees" shall mean all officers and employees who on the date specified in the scheme are the officers and employees of the Board or transferor, as the case may be.

Notwithstanding anything contained in the Foreign Exchange Management Act, 1999(42 of 1999) or any other law for the time being in force,-- (a) the Central Government shall appoint a Director of Enforcement in the Directorate of Enforcement in the Ministry of Finance on the recommendation of the Committee consisting of-- (i) the Central Vigilance Commissioner -- Chairperson; (ii) Vigilance Commissioners -- Members; (iii) Secretary to the Government of India in-charge of the Ministry of Home Affairs in the Central Government -- Member; (iv) Secretary to the Government of India in-charge of the Ministry of Personnel in the Central Government -- Member; (v) Secretary to the Government of India in-charge of the Department of Revenue, Ministry of Finance in the Central Government -- Member; (b) while making a recommendation, the Committee shall take into consideration the integrity and experience of the officers eligible for appointment; (c) no person below the rank of Additional Secretary to the Government of India shall be eligible for appointment as a Director of Enforcement; (d) a Director of Enforcement shall continue to hold office for a period of not less.....

Title: Appointment of Commissioner, Additional Commissioners, Joint Commissioners, Deputy Commissioners, Assistant Commissioners, State Representatives and Commercial Tax Officers

(1) The State Government may appoint a Commissioner of Commercial Taxes and as many Additional Commissioners, Joint Commissioners, Deputy Commissioners, Assistant Commissioners, State Representatives and Commercial Tax Officers, as they think fit for the purpose of performing the functions, respectively conferred on them by or under this Act or by or under any other law for the time being in force. (2) The Commissioner may, empower an officer not below the rank of an Assistant Commissioner or an Advocate or a Chartered Accountant or a Tax Practitioner enrolled in the prescribed manner to perform the functions of a State Representative. (3) In proceedings before the Appellate Tribunal, the State Representative shall be competent, - (a) to prepare and sign applications, appeals and other documents, (b) to appear, represent, act and plead, (c) to receive notices and other processes, and (d) to do all other acts connected with such proceedings, on behalf of the Government or any officer appointed under this Act.
